Fitness center staff found guilty of unsafe services entailing death of boy

A court has recognized the evidence collected by the Moscow Directorate of the Investigative Committee sufficient to convict CEO of a sports club Sergeo Roshchupkin and manager Irina Ter-Akopyan. They were found guilty of provision of services that do not meet safety standards under Part 1 of Article 238 of the RF Penal Code.

The court and investigators have revealed that on 3 December 2015, about 5 PM, a trainer did not pay attention to a 9-year-old boy who stayed in the swimming pool after a swimming lesson in a sports club in Krasnoarmeiskaya Street in Moscow. Sometime later the staff found the boy in water showing no signs of life. A forensic medical examination showed that the boy died of drowning.

The investigators studied job descriptions regulating actions of the staff and conduct in the swimming pool and found that the staff had failed to do their job properly which led to the tragedy. A forensic medical, two construction and technical, as well as legal inquiries were run and allowed the investigators to get the evidence of guilt of sports club’s managers.

The court has given Sergei Roshchupkin and Irina Ter-Akopyan a suspended sentenced of 2 years in prison each.

The defendants paid 7 million rubles of damages to the boy’s bother during the investigation.

Swimming instructor Yegor Bortnikov is hiding from the investigators. The case against him has been severed to form a separate lawsuit while he is internationally wanted.
