Probe launched against Chechen Republic commercial court judge

The Chairman of the RF Investigative Committee has initiated criminal proceedings against judge of the Chechen Republic Commercial Court Alu Bachayev suspected of giving an unjust judgment under Part 2 of Article 203 of the RF Penal Code.

According to investigators, on 4 May 2010 and 28 August 2012 Justice Bachayev issued a knowingly unjust judgment on satisfying the action filed by Simbioz Association, a non-commercial organization and exacting more than 5 billion rubles from the RF state treasury. The information about Bachayev’s crimes was gotten during an investigation conducted by the North Caucasus Federal District Directorate of the Investigative Committee against several people charged with grand stealing money from the federal budget.

The investigation established that Bachayev violated the RF Civil Code, Civil Procedure Code and Arbitrage Procedure Code when he knowingly failed to see that Simbioz Association created in 2002 succeeded from Simbioz Association of Cooperatives, which had acted in the 90s. Without legal grounds Bachayev recognized the legal succession of the said organization for a property transferred to the federal ownership and for the compensation for oil products not supplied by the Anisimov Novogroznensky Oil Refinery in 1991.

Unjust decision made by Justice Bachayev led the violation of justice principles guaranteed by the Russian Constitution and undermined the authority of justice system, as well as contributed to the stealing from the Russian budget more than 360 million rubles and an attempt to steal more than 4.6 billion rubles.

The RF Higher Qualification Board of Judges granted the petition filed by the Chairman of the Investigative Committee and consented to the investigation against Bachayev. The RF Supreme Court of Appeal did not change the decision and now it has come into legal force.

The North Caucasus Federal District Directorate of the Investigative Committee is now investigating the case carrying out urgent investigative and procedural operations. The case against the people charged with fraud is now being tried in a court.
