In Orenburg Region, police officer to stand trial for neglect of duty that later entailed death of minor

The Orenburg Regional Investigations Directorate of the Investigative Committee of the Russian Federation finished an investigation into a 34-year-old police officer of Police Department No. 1 of Orskoe Municipal Directorate of the Russian Ministry for Internal Affairs. He is charged with offences under Part 2 of Article 293 (neglect of duty, which has involved by negligence the death of a person) and Part 2 of Article 292 (official forgery, which entailed significant violation of the rights and lawful interest of citizens) of the Criminal Code of Russia.

According to the investigation, the defendant had neglected his duty via improper discharge of his duties while performing administrative supervision of a supervised person - had failed to respond to multiple oral reports of local citizens about the person’s beating his live-in partner, abusing of alcohol, misbehaving in the family with an infant child. The defendant had failed to introduce proper means of protecting the minor’s rights.

From January to October 2017, the defendant had been forging data on his repeated visits to the supervised person, thus, introducing false information into official documents. Hence, he had failed to carry out preventive control over the 37-year-old local.

That resulted in the man’s violent beating of his 5-year-old stepson while being alcohol and drug intoxicated in October 2017. The child had died on the scene of the inflicted injuries. The court had sentenced him for the commission of the especially grave offence to 18 years of imprisonment in a special-regime corrective labour colony, with 1.5 years of freedom restraint.

Under a request by the preliminary investigation, the police officer had been removed from his duties for the entire period of the investigation and up to the court’s decision coming in effect.

The defendant had not plead guilty during the preliminary investigation.

The probe was launched on the basis of information revealed by the Investigations Directorate during media monitoring.

The administration of the Police Department No. 1 of Orskoe Municipal Directorate of the Russian Ministry for Internal Affairs received a recommendation to eliminate the causes and conditions that had contributed to the commission of the offence.

The investigation gathered enough evidence; therefore, the criminal case with the approved indictment was sent to the court to be tried on the merits.
