In Krasnoyarsk Region, director of retirement home found guilty of rendering of services which do not meet safety standards


The court recognized the evidence gathered by the Krasnoyarsk Regional Directorate of the Investigative Committee of the Russian Federation as sufficient to issue an indictment to a director of a retirement home. He was found guilty of an offence under Part 1 of Article 238 (rendering of services which do not meet safety standards) of the Criminal Code of Russia.

The court recognized 15 individuals, relatives of deceased elderly people, as aggrieved persons.

The investigation and the court have established that, from September 2011 to June 2016, the defendant had been signing paid service contracts with relatives of elderly people amounting from 15,000 to 30,000 roubles per month. The contracts had featured services on permanent accommodation, assistance in personal hygiene, provision of nutrition, and calling for an ambulance given a deterioration of the person’s medical condition. The residents of 78-93 years old had been living in the home for hardly a month - two weeks in average. When their medical condition had deteriorated, they had not been provided with an ambulance, which had been causing their death. A sanitary and epidemiological forensic examination showed significant violations of sanitary standards posing a threat to lives and health of the retirement home’s residents; some of the violations had been previously detected by the Federal Service for the Oversight of Consumer Protection and Welfare but not eliminated by the director. The defendant did not plead guilty and did not confess.

The court announced the director of the retirement home to be guilty of the offence and sentenced him to 1 year and 6 month of supervised release; the probe was closed because the statute of limitation expired. The investigation will initiate an appeal in the Prosecutor’s Office.
