The Tver Regional Directorate of the Investigative Committee of the Russian Federation opened an investigation into an offence under Part 2 of Article 293 (neglect of duty) of the Criminal Code of Russia committed by functionaries of neglect and juvenile delinquency prevention authorities, as part of a probe into a murder of a 4-month-old girl.

To remind, on November 10, 2018, the Investigations Department of the Investigative Committee of Russia had been reported about the body of the 4-month-old girl with signs of strangulation found in an apartment in Proletarsky District of Tver. The Tver Regional Directorate of the Investigative Committee of Russia had opened the probe immediately. During the investigation, it was established that a 31-year-old woman had murdered her infant daughter on that day.

The probe materials state that, prior to November 4, 2018, the woman had been residing with her partner and their infant daughter, who had been supervised in paediatrics department of State Budgetary Healthcare Institution “Kalininskaya Central Regional Hospital”. It was also established that the girl’s father had been under administrative supervision for he had been previously convicted for offences, including those against person, and had been indicted for repeated violations of set restrictions and responsibilities. The man had not been officially employed and done odd jobs. In addition, the mother of his child and he had had conflicts while under the influence of alcohol, when he had been inflicting injuries upon her. With reference to that, he had been held administratively liable and supervised by the Juvenile Division of Tver Regional Kalininsky District Department of the Ministry for Internal Affairs of Russia.

Despite the task of neglect and juvenile delinquency prevention authorities to protect the rights and legitimate interests of minors; to carry out individual preventive work; and to timely identify families in a socially dangerous position; officers of the Tver Regional Kalininsky District Department of the Ministry for Internal Affairs of Russia, medical workers of State Budgetary Healthcare Institution “Kalininskaya Central Regional Hospital” carrying out patronage and observation of the child under the age of 1 year, the territorial department of social protection of the population, and other bodies of neglect and juvenile delinquency prevention authorities in Kalininsky District of Tver Region failed to take the necessary measures to prevent the unlawful behaviour of the child’s parents, as well as to timely detect the young girl’s being in a socially dangerous position and to take the latter from the family.

Thus, the said inaction had caused the murder of the girl on November 10, 2018.

As part of the probe into the neglect of duty, the investigators of the Investigative Committee will thoroughly examine and analyse all the circumstances, causes and conditions contributed to the commission of the offence. The investigation will provide for a legal assessment of completeness and timeliness of measures taken by prevention authorities.
