In Moscow Region, man committed offences against his wife found guilty


The evidence gathered by the Moscow Regional Directorate of the Investigative Committee of Russia was found by the court to be sufficient to sentence Dmitry Grachev. He was found guilty of intentional infliction of a grave health injury which involved a loss of an organ (Paragraphs B and H of Part 2 of Article 111 of the Criminal Code of Russia); as well as of abduction (Part 2 of Article 126 of the Criminal Code of Russia, two episodes) and threat of murder (Part 1 of Article 119 of the Criminal Code of Russia).

According to the investigation and the court, in December 2017, Grachev had had a criminal intent of infliction a grave health injury to his wife Margarita Gracheva, which had been motivated by jealousy. He had been preparing for committing of the crime from the beginning of December: in advance had purchased an axe and plastic ligatures in a hardware store, tourniquets of different sizes, a bandage and iodine in a pharmacy, and put it all in the trunk of his car. On December 11, he had taken away the mobile phone of his wife, blocked the doors in the car and driven her to a forest against her will. Following that, Grachev had walked his spouse out of the car, bound her arms and hit her wrists and hands with an axe at least ten times. His actions had caused grave health injuries to the victim.

Moreover, the investigation established that Grachev had already abducted his wife previously - on November 11, 2017. That time he had driven her to a forest against her will and threatened to kill her. After that Margarita Gracheva had filed a corresponding police report. However, on December 8, 2017, a district police officer had dismissed the criminal complaint due to lack of rational evidence of criminality in the actions of Dmitriy Grachev, despite the fact that the investigative activities had not been performed to the full. With the decision, the police officer had violated the constitutional right of Margarita Gracheva to be protected against adverse actions and had created a sense of impunity in Grachev’s mind contributing to his intent of infliction of a grave health injury to his wife. That was what he had done on December 11, two days following the order to dismiss the criminal complaint. He had brought his wife to the forest to cut her hands off. A separate probe was launched into neglect of duty (Part 1 of Article 293 of the Criminal Code of Russia) by the district police officer.

The court sentenced Dmitry Grachev to 14 years of imprisonment in a strict regime penal colony. The court also sentenced Grachev to pay 2.035 million roubles of moral damage.
