Upon Alexander Bastrykin’s instruction, probe into Acting Chief Medical Officer of maternity hospital in Kaliningrad referred to Central Office of the Investigative Committee of Russia

The investigation earlier initiated by the Kaliningrad Regional Directorate of the Investigative Committee of Russia into the Acting Chief Medical Officer of the State Budgetary Health Institution “Kaliningrad Regional Maternity Hospital No. 4” was referred to the Central Office upon instruction of Chairman of the Chairman of the Investigative Committee of Russia Alexander Bastrykin for an impartial, comprehensive and effective investigation. To remind, the woman is accused of committing offences under Paragraph C of Part 3 and Part 1 of Article 286 of the Criminal Code of Russia (exceeding official powers); she was charged on November 22, 2018.

The investigation arranged a forensic examination of the causes of death of the new-born, which has not been completed yet. During the investigation, all the circumstances of the incident and procedure participants arguments, including the circumstances of the medical documents forgery – labour and delivery record, where at the instructions of the Acting Head Doctor false information about the alleged death of the foetus was introduced, will be carefully checked. Upon the results of the investigation, an appropriate legal evaluation will be given to actions of the maternity hospital’s medical staff.

In his turn, Alexander Bastrykin repeatedly stressed that investigators take each such probe very seriously and their primary goal is to establish the truth and bring upon the perpetrators the responsibility established by the law if they are proven guilty.

Investigators of the Investigative Committee of Russia by no means seek to create a negative image of medical workers or besmirch their reputation; however, due to the increasing number of citizens’ complaints about doctors’ actions, the investigative authorities are obliged to respond to such reports and give them legal assessment.

To remind, under the agreements between Chairman of the Investigative Committee of Russia Alexander Bastrykin and President of the Union of the Medical Community “National Medical Chamber” Leonid Roshal, an interdepartmental working group on preparation of amendments to the Criminal Code of the Russian Federation concerning the establishment of special standards of medical workers’ responsibility for service crimes was created. The working group’s purpose is to improve law enforcement practice, which, on the one hand, will help eliminate cases of baseless criminal prosecution of doctors, and on the other hand, will protect more effectively the rights of patients from possible unqualified medical workers’ actions.
