A probe launched in Nizhny Novgorod Region into negligence of juvenile delinquency prevention authorities that alllowed teenagers to commit an especially grave offence

The Nizhny Novgorod Regional Directorate of the Investigative Committee of Russia launched a probe into negligence of officers of Vyksa police juvenile department that allowed teenagers to commit an especially grave offence against a man (Part 2 of Article 293 of the Criminal Code of Russia).

Earlier investigators of Vyksa investigative department of Nizhny Novgorod Regional Directorate of the Investigative Committee of Russia had launched a probe under Part 4 of Article 111 of the Criminal Code of Russia into beating of a 59-year-old man entailed by his death. According to investigation, on October 28, 2018, two 14-year-old students living in Vyksa in Nizhny Novgorod Region stole several radiators from a construction site and decided to store the stolen items in an apartment of the victimized man familiar to one of the minors. On the next day, having found that the radiators were missing, the teenagers severely beat the owner of the apartment under suspiction of theft. The man died in a hospital.

An 18-year-old Vyksa citizen found out that teenagers had been involved in the death of a man he knew, found them and forced them to commit unlawful acts on November 13. The suspect was detained under Article 91 of the Criminal Procedural Code of Russia and charged with the committed crime. He didn't plead guilty. Under an investigative motion, the court ruled to put the suspect in custody.

Both teenagers were arrested on November 15, 2018. They have been charged and subject to house detention. They have pleaded guilty,

During examination of the accused minors personalities the investigators established that both teenagers are under supervision by Vyksa juvenile delinquency prevention authorities and have previously committed generally dangerous acts they escaped liability for due to minor age. The obtained data show that Vyksa juvenile delinquency prevention authorities failed to discharge their duties in prevention of crimes committed by minors. They didn't take required measures to monitor teenagers under supervision despite having information that the minors have tendencies to commit offences and crimes. These tendencies and the complicity of juvenile delinquency prevention authorities enabled the teenagers to commit an especially grave offence which involved death of a person.

Moreover, the investigation checked the agility of search for the minors carried out by the Vyksa officers of the Ministry of the Internal Affairs that knew about them committing the offence since November 1, 2018. The adequate performance of the police officers in timely arrest of the minors would have prevented committing an offence against them.

Investigators send the Nizhny Novgorod Main Directorate of the Ministry of Internal Affairs a recommendation regarding chiefs of Vyksa police department responsible for institutional control over work of subordinate juvenile delinquency prevention authorities.

The investigation of probes is under supervision of the Central Office of the Investigative Committee of the Russian Federation.
