Alexander Bastrykin holds personal reception of citizens in Moscow

The Chairman of the Investigative Committee of the Russian Federation held a personal reception of citizens’ session in Moscow. The reception was also hosted by Deputy Chairman of the Investigative Committee Igor Krasnov; chiefs of several Central Office divisions; as well as chiefs and employees of regional investigations directorates that process the probes and examination materials that drew attention of the Chairman. The session was attended by citizens from Moscow Region, Rostov Region, Yaroslavl Region, Saratov Regions, Perm Territory, and the Republic of North Ossetia-Alania.

A Rostov-on-Don citizen applied to the personal reception with a complaint about non-bringing to justice persons who had induced his son to drug use that entailed his death. At the moment, Rostov Regional Directorate of the Investigative Committee of Russia is investigating a probe into the infliction of death by negligence, and the police are investigating a probe into illegal traffic of drugs. Having listened to a report of the Chief of Investigative Department for Voroshilovsky district of Rostov-on-Don, the Chairman of the Investigative Committee of Russia noted a number of violations: red-tapery and incompleteness of investigative activities and obvious lack of interest in a swift and comprehensive investigation of the probe shown by the investigator. Reasons of the tragedy are yet to be determined as well as identities and roles of teenagers who contacted the deceased teenager shortly before his death. Therefore, the Chairman decided to refer the probe to the Central Office for further investigation. Official assessments are arranged into the investigator, the Chief of Investigative Department and the Chief of Department for Procedural Control; all of them are suspended for the time of assessments.

A woman from Saratov Region complained that her husband, who had disappeared in 2012, still was not found. According to her, investigation did not interview all witnesses and failed to perform necessary investigative activities. The Chairman of the Investigative Committee of Russia noted poor performance of forensic experts for this probe and decided to refer it to the Central Office for further investigation.

At the personal reception session, a woman from Yaroslavl Region told the Chairman about an illegal search carried out in 2015 and lack of legal assessment of the actions of law enforcement authorities that had violated her rights. Having analysed reports of investigators and other staff members of the Yaroslavl Regional Directorate, Alexander Bastrykin pointed out their red-tapery and gross procedural errors in carrying out investigative activities. The Chairman of the Investigative Committee of Russia arranged a legal assessment of actions of the investigators that had violated requirements of the criminal procedural law. Taking into account that the probe is processed by a young investigator, the Chairman instructed the Central Office to assess the organisation of education of young specialists in the Regional Investigative Directorate.

A man from Perm Territory expressed his disagreement with a decision on termination of a probe into abuse of authority by the Main Investigations Directorate of the Ministry of Internal Affairs for Perm Territory and complaint about Investigative Committee continued failure to take action against a staff member of the Federal Service for State Registration, Cadastre and Cartography who had registered two pieces of land formed as a result of demarcation of a land plot being a construction site for residential houses and administrative buildings. The registration was made without consent of the relevant authority, Perm Municipal Administration. Upon review of this complaint, Alexander Bastrykin instructed his subordinates to prepare a motion for General Prosecutor’s Office to refer the probe from the police and decided on a probe into staff member of the Federal Service for State Registration, Cadastre and Cartography abuse of authority to be investigated by the Central Office. He also arranged an official assessment into the investigator and the Chief of Investigative Department for Leninsky District of Perm.

A citizen of the Republic of North Ossetia-Alania complained that the investigation failed to give legal assessment of actions of persons that had extorted money from her son and subsequently murdered him. Only one of the shooters was charged, others appear as witnesses. Upon review of this complaint, Alexander Bastrykin decided to refer the probe to the Main Investigations Directorate over the North Caucasian Federal District for further investigation. The Chairman of the Committee instructed to identify all persons involved in the crime and to give a legal assessment of their actions. Investigators who processed and are processing the probe, their chiefs and authorities responsible for procedural control over the investigation are subject to official assessment.

The Chairman of the Investigative Committee of Russia instructed the Human Resources Directorate to eliminate one investigator post from each regional investigative institution, the probes of which were referred to the Central Office during the personal reception session.

Moreover, the Chairman of the Investigative Committee of Russia was addressed by an initiative group of parents whose children attended a school that was closed during the study year. In October 2018, the Russian Ministry of Enlightenment issued an order to suspend education process in Gorki general school in Leninsky district of Moscow Region due to violations of sanitary and epidemiological requirements detected by the Federal Service for the Oversight of Consumer Protection and Welfare. The parents complained on major violations of rights of children that had to spend 1.5-2 hours to get to schools located in other localities. According to the applicants, the Ministry of Enlightenment has severely violated the law. The Moscow Regional Directorate of the Investigative Committee of Russia has launched a probe into negligence. Alexander Bastrykin decided to refer the probe to the Central Office for a full and comprehensive investigation.

The progress on all complaints and petitions addressed was taken under the personal control of the Chairman.
