Chairman of the Investigative Committee of Russia takes part in 7th Congress of the National Medical Chamber


The Chairman of the Investigative Committee of Russia took part in the 7th Congress of the National Medical Chamber.

Delivering a speech, the Chairman of the Investigative Committee of Russia reminded of the importance and relevance of matters related to the improvement of the quality and accessibility of healthcare services and protection of patients from medical errors.

Alexander Bastrykin stated that there were numerous incidents when certain doctors in their professional activities made errors that entailed unfavorable consequences for their patients. According to the Investigative Committee statistics, in H1 2019, 224 persons have been recognized as victims and 159 of them died due to medical errors and inadequate rendering of healthcare services.

“We launch probes in order to establish all circumstances and causal links between the organization of the treatment process and infliction of unfavorable consequences for the patient,” Alexander Bastrykin explained. In this, he highlighted that investigation of such criminal cases is a legitimate way to establish impartial truth, not a tool for criminal prosecution of a certain doctor, and a significant number of such probes are suspended in the absence of evidence of the crime. Statistics provided by the Chairman of the Investigative Committee of Russia proves it: “In 2017, we launched 1,791 probes, 175 of those were referred to the court, and eight persons were acquitted. In 2018, we launched 2,229 probes, 265 of those were referred to the court, and 21 persons were acquitted. In H1 2019, we launched 1,227 probes, 158 of those were referred to the court, and 12 medical workers were acquitted.”

Alexander Bastrykin noted that in order to investigate such probes in a comprehensive and impartial manner, “we need to constantly improve interaction in the development of regulatory acts providing requirements for rules and standards of rendering medical aid and use of all capacities of forensic examinations that play the key role in the result of a probe.” The Chairman reminded that the Investigative Committee of Russia had already taken a number of measures including the arrangement of forensic examination in medical institutions outside the region of the incident, or in Moscow. Investigators also need to apply complex examinations more widely.

Alexander Bastrykin also supported the idea to include the term of a medical error in the new draft law initiated by the medical community.

The Chairman of the Investigative Committee of Russia thanked Leonid Roshal for his assistance in holding personal receptions of citizens who faced inadequate medical care. Alexander Bastrykin suggested introducing the practice of joint personal receptions of officers of the Investigative Committee of Russia and representatives of the medical community in the regions.

Summarizing the provided facts, Alexander Bastrykin underlined that considered approaches to existing problems could be developed only in close interaction.
