In the Republic of Dagestan, former Chief Architect of Makhachkala City found guilty of exceeding official powers


The evidence collected by the Dagestan Republican Investigations Directorate of the Investigative Committee of the Russian Federation has been found by the court to be sufficient to sentence former Head of the Architecture and Urban Design Administration of Makhachkala Magomedrasul Gitinov. He has been found guilty of committing offenses under Part 1 of Article 286 and Paragraph C of Part 3 of Article 286 of the Criminal Code of Russia (exceeding official powers).

The investigation and the court established that, in 2014-2017, Gitinov had illegally granted to six constructors town-planning documents permitting to build apartment houses on land plots located in the area for private housing construction.

Thus, in February 2015, Gitinov, obviously exceeding his official powers, had composed a town plan of a 600 m2 land plot located on Timiryazeva Street of Makhachkala, violating the boundaries of the land plot belonging to a local citizen. Based on this plan, in May 2015, the Architectural and Construction Oversight Directorate of the Makhachkala Administration had issued a construction permit for the construction of a multi-story residential building on this land plot to the Granit LLC construction company. As a result of Gitinov’s illegal actions, the construction zone had partially covered the land plot belonging to the citizen, including the area on which Granit LLC had fulfilled foundation works.

In February 2017, under a civil claim of the citizen against the city administration, the court had ruled to demolish the unfinished construction object - the foundation of a 12-story apartment building at the expense of the city administration.

Gitinov’s illegal actions had inflicted damage of approximately 6 million rubles to the city administration, which significantly violated the legal interests of the municipality and caused grave consequences.

Apart from that, in 2015, he had illegally issued to a construction firm a town plan, on which he had intentionally avoided putting information about a 5-floor-building located on the land plot and restrictions of the use of the land plots due to their location in a sanitary protection zone of a closed cemetery; he also approved a residential building project.

Gitinov has been sentenced to 4.5 years of imprisonment suspended and to deprivation of the right to occupy public service positions for a period of 3 years.
