In Moscow, a sentence imposed over participants of an interregional criminal group

The evidence gathered by the Moscow Main Investigative Department of the Investigative Committee of Russia was found by court to be sufficient to impose a sentence based an indictment issued by the jury over Dmitry Lesnyakov and Dmitry Zavyalov, being the interregional criminal group leaders, and six members of their group - Dmitry Zadkov, Valery Babaev, Alexander Lebedev, Ralif Faizov, Sergey Freer and Idrak Abilov. Depending on the role of each they were found guilty of committing offences under Paragraphs A, F, G, H of Part 2 of Article 105, Part 3 and 4 of Article 111, Part 3 of Article 161, Paragraphs A, C of Part 3 and Paragraphs A, B, C of Part 4 of Article 162, Part 1 and Part 2 of Article 209, Part 1 and Part 2 of Article 210, Part 2 of Article 213, Part 3 of Article 222 of the Criminal Code of Russia (banditry; organization of a criminal community and participation in it; attempted murder and murders; intentional infliction of severe health damage, including that entailing death of a victim; illegal turnover of weapons; hooliganism; robbery).

During the period from 1999 to 2011 Dmitry Lesnyakov and Dmitry Zavyalov were leading an interregional criminal group that at different time included Dmitry Zadkov, Valery Babaev, Alexander Lebedev, Ralif Faizov, Sergey Freer, Idrak Abilov and other persons. The participants of the criminal community committed over 40 grave and especially grave offenses including murders, intentional inflictions of severe health damage and robberies in Moscow, Chelyabinsk, Moscow and Rostov Regions and Krasnodar Territory.

The activities of the criminal organization were characterized by sustainability, strict discipline, careful preparations, planning of offenses and conspiracy. That helped them to avoid detention for such a long time. However, due to professionalism of one of the most experienced investigators of the Moscow Department of the Investigative Committee of Russia and officers of operative units it was possible to neutralize the accomplices.

The investigation established that the participants of the community encroached on people that for some reasons conflicted with its leaders and commercial organizations controlled by it. That's what happened in case of murder of a Rostov businessman and his security guard. On November 14, 2006 Lesnyakov, Zavyalov, Faizov and Freer together with other three accomplices shot them from machine guns in the courtyard of a residential building on Udaltsova Street in Moscow in order to eliminate competitors, due to being interested in expanding criminal spheres of influence and expanding their authority in the city of Rostov-on-Don.

At present investigation into other participants of the organized gang is ongoing, other episodes of their criminal activities are being established.

Basing on the indictment the court sentenced Dmitry Lesnyakov, Dmitry Zavyalov and Ralif Faizov to life-time imprisonment in a special regime penal colony. Other criminal group members were sentenced to 12-23 years of imprisonment in general and strict regime penal colonies.

The Investigative Committee of Russia pays special attention to investigation of part years crimes focusing on the principle of the inevitability of punishment, regardless of the statute of limitations for the crime committed.
