The evidence collected by the 1st Moscow Military Investigative Department of the Investigative Committee of Russia was recognized by the court as sufficient for sentencing the former head of the housing maintenance department of Military Unit 3111, Major Kirill Prokudin, and the former deputy director of the Federal National Guard troops of the Russian Federation - Commander in Chief of the National Guard troops of the Russian Federation, Lieutenant-General Sergey Mileyko, a reserve. Depending on the role of each they were found guilty of committing offenses under Part 4 of Article 159 (swindling committed on an especially large scale) and Part 3 of Article 33, Part 4 of Article 159 of the Criminal Code of Russia (organization of swindling on an especially large scale).
Investigation and the court established that from April 2006 to June 2012 Mileiko together with Prokudin deceived authorities of Balashikha, Moscow Region, having submitted forged documents containing false data on the right of operational management of the military unit on the premises in Balashikha. Subsequently, they prepared a forged agreement on the transfer of the said premises into the possession of the citizen, on the basis of which the state authorities registered the citizen's title to the said premises.
In May 2012, a fictitious contract for the sale of these premises was concluded with the wife of Mileyko, on the basis of which the state authorities made the registration of ownership rights.
Thus, the actions of these persons stole and embezzled property belonging to the state in the amount of over 9 million rubles.
The court sentenced Mileyko to imprisonment for 6 years to be served in a penal colony of general regime, a fine of 600 thousand rubles, the military rank of "reserve general" and the right to hold positions of authority, as well as organizational and administrative authority for a period of 3 years.
Prokudin was sentenced to 4 years of imprisonment in a penal general regime penal colony, a fine of 400 thousand rubles, the military rank of "major" and the right to hold positions related to the exercise of the functions of a representative of power, as well as organizational and administrative authority for 2 years.
In addition, the court verdict returned the stolen property to the state.
