The Chairman of the Investigative Committee of Russia held another reception on the violation of the rights of citizens in Vsevolozhsky district of Leningrad region


The Chairman of the Investigative Committee of Russia Alexander Ivanovich Bastrykin held another personal reception of citizens in a video-conference on the investigation of criminal cases and inspections by the investigative department of Vsevolozhsk. The event was attended by First Deputy Chairman of the Investigative Committee of Russia Eduard Valeryevich Kaburneyev, Deputy Chairman of the Investigative Committee of Russia Sergey Nikolaevich Goryainov, heads of departments of the Central Office of the Committee. S. T. Sazin, Head of the Investigative Committee of Russia for the Leningrad region, A. V. Demchenko, Head of the Department for Vsevolozhsk, and employees of this department were also invited to the reception of citizens.

A representative of the victim from Vsevolozhsk district appealed in connection with the red tape allowed by the investigator of the investigation department in a criminal case about partial non-payment of wages. He asked the head of the agency to take measures aimed at eliminating procedural violations and ensuring payment to the employee. The man also complained about ignoring of previously spoken arguments by the Vsevolozhsk investigative department officers. The head of the investigation department, A.V. Demchenko, presented a report on the issue. The Chairman of the Investigative Committee of Russia noted the omissions of the investigator and the leadership of the investigative department. The head of the Committee instructed his deputy S.N. Goryainov to organize an official check, within which to verify all the circumstances voiced by the complainant. S.T. Sazin, Head of the Leningrad Regional Investigative Department of the Investigative Committee of Russia, was instructed by the Chairman of the Investigative Committee of Russia to organize a procedural review of the information provided during the reception and previously overlooked by employees of the investigative department.

A group of residents of Vsevolozhsk District of the Leningrad Region, including a member of the Public Council under the Ministry of Natural Resources and Ecology of the Russian Federation, appealed to Alexander Ivanovich Bastrykin regarding the violation of the rights of participants in several gardening cooperatives. Among them: Osinka, Silver Creek, North Pearl, Vasilievka, and Solnechnoye. All of them complained about inadequate consideration of their appeals, procedural checks and the investigation of a number of criminal cases in the Investigative Department for the city of Vsevolozhsk.

 For example, citizens have voiced arguments about systematic violations by local authorities of environmental and land legislation, the illegal disposal of lands of the Russian Ministry of Defense, which were originally intended for military pensioners, but as a result of fraudulent schemes, with the participation of local government officials, were transferred to third parties. The complainants complained to the head of the agency about the inability to reach representatives of regional law enforcement agencies and the lack of any measures to restore their violated rights.

"What I'm hearing from people is evidence of failures that need to be looked at most closely, and that's not happening. It is necessary to hold receptions for citizens, because people come, whose interests we have to protect. I do not believe that so many people can get together and talk for nothing", said the Chairman of the Investigative Committee.

An assessment has been carried out on the circumstances previously voiced in the Investigative Division in Vsevolozhsk, the initiation of criminal proceedings was denied. This decision has now been reversed and an additional check has been organized. The complainants asked the head of the agency to give a comprehensive legal assessment to the actions of officials of local administrations.

In addition, one of the complainants complained that the fact of illegal demolition of his house on a plot in one of the gardening cooperatives is directly related to the illegal seizure of land and asked the head of the department to organize a check of all the circumstances of what happened. The Chairman of Investigative Committee of Russia was reported that currently in the investigation department of particularly important cases of Investigative Committee of Russia for the Leningrad region there is a criminal case under Part 1 of Article 201, Part 2 of Article 167 of the Criminal Code against the lawyer Kudrin A.V. and Rusyaev V.N. Alexander Ivanovich demanded from his subordinates to ensure quality and prompt investigation of the criminal case.

The complainant from the Solnechnoye cooperative and her representative appealed in connection with the illegal alienation of common use land, on which socially important facilities are located, in favor of one of the members of the partnership. The latter forces the members of the community to buy these lands. During the reception it was found out that the Vsevolozhsk Criminal Investigation Department received a complaint about these facts, pointing to signs of fraud. However, investigator D.R. Mukhutdinov, with the knowledge of the head of the department, decided to transfer them to the bodies of internal affairs.

By decision of the Chairman of the Investigative Committee of Russia A.V. Demchenko and investigator D.R. Mukhutdinov were suspended from their duties for the duration of the official investigation, and all the circumstances voiced by the complainant will be examined by investigators from the Central Office of the Committee.

Complainants from the town of Kudrovo, Vsevolozhsk district, also voiced arguments related to violations of land laws, namely the facts of illegal seizure of more than 100 hectares of land from the category of agricultural use, located near apartment buildings. They explained that car washes and parking lots were erected on these plots, and household garbage dumps were organized. A four-lane thoroughfare was built in place of the adjacent property. The complainants believe that the plots were stolen through fraudulent schemes involving cadastral engineers, officials from the administration of Zanevsky urban settlement and the head of the Vsevolozhsk district administration. They also complained about inadequate work by the region's law enforcement agencies: no measures to remedy the situation have been taken to this day.

Another group of complainants asked about exercising a legal right. For six years, a family with many children has been unable to obtain the land for individual housing construction that is required by law. The administration refers to the lack of sites in Vsevolozhsk area, and offers to wait for their appearance. At the same time, the line of applicants is not moving. Land plots with connected communications, previously assumed to be issued to large families, are now sold by the administration at auctions. Head of the Investigative Committee of Russia in the Leningrad Region S.T. Sazin reported that the circumstances voiced were the subject of verification, which resulted in a criminal case under Article 293 of the Criminal Code.

The Chairman of the Investigative Committee of Russia decided, as part of an internal review, to analyze the work done in the regional division of the Investigative Committee of Russia to address the arguments mentioned by the complainants.
