In Voronezh Region the investigation of a criminal case against a former official accused of negligence in providing housing to citizens from the number of orphans completed

The Voronezh Regional Investigative Department of the Investigative Committee of Russia finished investigation of a probe into a 38-year-old former head of the department of social protection of the Voronezh region, accused of committing a crime under part 1 of Art. 293 of the Criminal Code (negligence).

 The investigation established that the accused, being in possession of information that the apartment on Sovetskaya street in Borisoglebsk was in an unfit condition for habitation and had a debt for utilities of over 25 thousand rubles, which made it impossible to provide the apartment by entering into a contract for rent of specialized housing in the Voronezh Region, did not prevent the illegal conclusion of an agreement with a 24-year-old local resident from among people left without parental care. The conclusion of this contract, carried out due to the negligent actions of the accused, led to the subsequent removal of the girl from the register as in need of housing, where she had been since November 2015.

Later, due to the impossibility of living in an uncomfortable apartment and the existing debt for utilities, the intention to repay which the girl was misled about, at the initiative of the latter, the previously concluded lease agreement was terminated, which entailed the deprivation of the orphan of the legally stipulated right to provide housing. In addition, the former official did not take appropriate measures to purchase housing (apartments) to provide them to orphans and persons left without parental care, in form of organization of competitive (auction) procedures, which in the period from January to June 2020 were declared void due to lack of applications for participation. As a result, 377 apartments for this category of citizens were purchased in September-December 2020, which led to a significant violation of their rights and legitimate interests, expressed in the long-term non-provision of housing.

During the preliminary investigation, the defendant pleaded innocent of committing the crime. Despite this, the investigation has collected a sufficient evidentiary base, which was based on the testimony of 377 victims and numerous witnesses, the conclusion of construction-technical forensic examination, inspection and excavation protocols, during which the tender (auction) and other official documentation was obtained, other investigative and procedural actions were carried out that allowed to accuse the suspect of the incriminated act. As a result, the probe that consisted of 34 volumes with the indictment approved by the prosecutor was sent to the court to be tried on the merits.
