In Altai Territory, investigation of a criminal case into abuse of authority at provision of housing to orphan children, completed

The Altai Territorial Investigative Department of the Investigative Committee of Russia completed investigation of a criminal case against the former head of the regional government agency "Regional Housing Administration". He is accused of committing crimes under Part 1 of Article 285 of the Criminal Code (abuse of authority) and Part 2 of Article 315 of the Criminal Code (malicious failure to enforce court decisions).

Upon instructions of the Chairman of the Investigative Committee of Russia, the course of the criminal investigation was placed under control in the central office of the agency.

According to the investigation, in 2020, the Regional Housing Authority was given budget commitment limits in the amount of 1 billion 200 million rubles to purchase 757 apartments in the Altai Territory to provide them to persons belonging to a particular category of citizens - orphans and children left without parental care. Wishing to conceal his incompetence in an efficient use of the allocated funds and fulfillment of all targets, during a year the head of the institution illegally instructed his subordinate employees to send similar requests for purchase of housing only in big cities of Altai Territory, in order to artificially increase the number of procurement procedures for positive reporting, ignoring the necessity to provide citizens with housing on a first-come-first-served basis.

Thus, 1165 procurement procedures were held only in 23 municipal entities of the region. At the same time, 915 procedures were declared failed, and more than 500 of them were held only at the end of 2020. Thus, only 400 million rubles of the entire allocated amount was used. The accused used artificially obtained figures in the formation of a positive report to the higher authorities of state agencies, citing the alleged objective impossibility of development of all allocated limits of budgetary obligations. By performing these actions, the accused violated the rights and legitimate interests of orphans and children deprived of parental care, for whom there was a realistic possibility of purchasing several hundred apartments in the region in 2020. In addition, the official maliciously failed to execute court decisions that came into force in respect of persons belonging to the aforementioned category of citizens.

During the preliminary investigation, the head of the institution pleaded not guilty. However, the investigation carried out a significant amount of work: more than 2.5 thousand witnesses and victims were questioned, hundreds of searches, seizures and examinations were carried out. Complex commodity, accounting and appraisal forensic examinations were studied. A total of 188 volumes of criminal case materials were collected.

As a result of competently planned and conducted investigative and procedural actions sufficient evidence was gathered, and therefore the criminal case with the approved indictment was sent to court to be considered on the merits.
