The temporarily suspended mayor of Tomsk was found guilty of abuse of power and unlawful participation in business activities


Evidence gathered by the Tomsk Regional Investigative Department of the Investigative Committee of Russia was found sufficient to convict the temporarily removed mayor of Tomsk, who was found guilty of committing two episodes of crimes under Part 2 of Article 285 of the Criminal Code (abuse of power by the head of the local government) and Article 289 of the Criminal Code (illegal participation in business activities).

As established by the investigation and the court, the defendant, as Mayor of Tomsk, from June 2016 to May 2017, acting illegally, in the interests of OJSC "Tomsk Beer," one of whose shareholders he is, abusing his official powers, gave illegal instructions to subordinate employees of Tomsk City Administration to prepare on his behalf a resolution to reject an application from a Tomsk entrepreneur to change the type of territorial zone of the land plot located in the vicinity of Tomsk, which he owned. At the same time, in order to give the appearance of legality to his actions, the defendant ordered to indicate the presence of a sanitary protection zone on this territory, and subsequently to introduce false information about it into the Tomsk City General Plan. Subsequently, he signed the aforementioned decree, according to which the entrepreneur's application was rejected.

In 2015, the defendant illegally instructed the subordinate employees of the Tomsk City Administration to provide a land plot located at 44/2 Pasteur Street in Tomsk to his daughter without conducting an auction in the form of an auction, that is, in violation of the current legislation of the Russian Federation. Subsequently, the administration of the city of Tomsk and the mayor's daughter concluded a contract of sale of the said land plot of 852 square meters at a minimum (redemption) price, lower than the market value established at that time.

He, being the Mayor of Tomsk, having transferred his shareholding in Tomsk Beer OJSC to his wife in trust, contrary to the prohibition established by federal law, from October 2013 to November 2020, personally and through his proxy (wife) exercised control over the activities of Tomsk Beer OJSC in the areas of its operation and development, took managerial decisions on behalf and in the interests of Tomsk Beer OJSC, and also protected, assisted and promoted the said organization personally and with the complicity of his deputy, creating favorable conditions for its business activities.

In the shortest possible time more than a hundred witnesses in the case were questioned, a number of forensic examinations were appointed, which allowed to form the evidence base, to bring charges in the final version and complete the investigation of the criminal case in three months.

The Soviet District Court of Tomsk found the defendant guilty of committing the incriminated acts and sentenced him to 2 years of imprisonment to be served in a penal colony of general security with a fine of 200 thousand rubles, and deprivation of the right to hold certain positions for 3 years.
