Verdict Passed in Criminal Case on Former Acting Prosecutor of Norilsk Receiving Bribe

The court considered the evidence collected by the Main Investigative Department of the IC of Russia sufficient for sentencing former acting prosecutor of Norilsk Khavazh-Baudi Gutaev, his brother Dokka Gutaev, and OJSC Zarya director Farid Babaev. Khavazh-Baudi Gutaev was found guilty of receiving a bribe (Paragraph C of Part 5 of Article 290 of the Criminal Code) through the mediation of his brother, Dokka Gutaev (Paragraph B of Part 3 of Article 291.1 of the Criminal Code), from Babaev (Paragraph B of Part 4 of Article 291 of the Criminal Code).

The investigators and the court found that during the period from October 25 to November 7, 2018, being in Norilsk, through his brother's mediation, Acting Prosecutor Gutaev received RUB 399 thousand as a bribe from Babaev. The funds were intended for not taking prosecutor's response measures of filing a court claim to prohibit the operation of the restaurant building owned by OJSC Zarya in connection with violations of fire safety rules.

During the investigation of the criminal case, the defendants' property in excess of RUB 20 million was seized.

The court sentenced Khavazh-Baudi Gutaev to 11 years of imprisonment in a maximum security penal colony, a fine of RUB 10 million 773 thousand, a 5-year ban on holding public service positions, as well as deprivation of a class rank – junior councilor of justice. His brother, Dokka Gutaev, was sentenced to 9 years of imprisonment in a medium security penal colony with a fine of RUB 7 million 980 thousand. Babaev was sentenced to 7 years and 10 months of imprisonment in a maximum security penal colony with a fine of RUB 13 million 167 thousand.

In addition, the court is currently considering another criminal case against Khavazh-Baudi Gutaev and Muslim Umarov. Gutaev is accused of committing a crime under Part 6 of Article 290 of the Criminal Code (taking a bribe), Umarov – Part 5 of Article 291 of the Criminal Code (giving a bribe).
