Former Head of Kansk Found Guilty of Negligence That Caused Death of People

The court has recognized the evidence collected by the Main Investigative Department of the Investigative Committee of Russia sufficient to convict Nadezhda Kachan, the former head of the city of Kansk, Krasnoyarsk Krai. She was found guilty of committing a crime under Part 3 of Article 293 of the Criminal Code of Russia (negligence resulting in the death of two or more persons by negligence).

The investigators and the court found that the former head of the city was reliably informed about the situation that arose on May 24, 2017 in Kansk, where residential buildings along Tikhaya, 2-ya Tikhaya, and Nikolenko streets were engulfed in fire, but failed to timely establish the emergency regime and notify the citizens about the threat and occurrence of an emergency situation, which subsequently led to a large-scale spread of fire. As a result of the fire, 72 residential buildings were damaged, three citizens were killed and property damage amounting to RUB 188 million was caused. In total, more than 300 people were recognized as victims in the criminal case. The incident happened due to Kachan's negligent attitude to performing her official duties.

The court sentenced Kachan to three years of suspended imprisonment with a probation period of three years.

In addition, Kachan was charged with committing a crime under paragraph 1.1 of Article 293 of the Criminal Code (negligence that caused particularly large-scale damage). Being reliably informed that the North-Western industrial district of the city housed a significant number of landfills with sawmilling waste resulted from production activities of legal entities and individuals, she failed to secure the funding required to implement proper municipal land control, failed to file a draft plan for preventing the possible consequences of ignition of these landfills with the Kansk City Council and municipality heads, failed to establish proper interaction between municipal institutions to resolve situations, as well as ignored several decisions of the city court and instructions of regulatory authorities related to liquidation of the landfills.

On May 7, 2017, as a result of careless handling of unidentified persons' waste at the sawmill waste landfill, a fire broke out and subsequently spread to several production areas, resulting in RUB 72 million of damage.

Due to the expiration of the statute of limitations, the criminal prosecution of Kachan under Paragraph 1.1 of Article 293 of the Criminal Code was terminated by the court on non-rehabilitating grounds.
