The Chairman of the Investigative Committee of Russia takes part in the X International Legal Forum in St. Petersburg

Mr. A.I. Bastrykin - the Chairman of the Investigative Committee of Russia spoke at the meeting of the "Philosophy and Law" section in the X-th St. Petersburg International Legal Forum. In the event, moderated by Mr. A.N. Savenkov - the Principal of the Institute of State and Law of the Russian Academy of Sciences, and also attended by the Honored Lawyer of the Russian Federation, Mr. V.N. Pligin - Co-Chairman of the Association of Lawyers of Russia, Mr. A.A. Fedortsov - the judge of the Court of the Eurasian Economic Union, Ms. V.V. Lapaeva, Mr.I.I. Butrim and Mr. A.V. Gabov - the research-officials of the Institute of State and Law of the Russian Academy of Sciences and other legal scholars, including those representing the legal science of other states.

The Chairman of the Investigative Committee touched upon the historical aspects of the essence of law formation, upon its values and significance in the life of society and the state, upon their significance in the fate of peoples and mankind. The Head of the Body expressed the opinion that Western legal systems should be applied in Russian law and legislation through the prism of domestic traditions, since the entire state and law enforcement structure should act in the interests of the Russian people. He emphasized that in the presence of positive borrowings in the form of the institution of the adversarial nature of the criminal process, so it is impossible to abandon the category of objective truth as the ultimate goal of the proving process. “Knowledge of the truth is a philosophical category; it must exist both in legal reality, and in law enforcement, and, in particular, in criminal proceedings. Otherwise, the equivocation takes the advantage ...”- emphasized Mr. A.I. Bastrykin.

The Head of the department noted that a there was a bill, which was  initiated on the amending the Criminal Procedure Code of the Russian Federation with the active participation of the Investigative Committee, this bill proposed a model of balanced competition, orienting the subjects of proof to an active and impartial role in knowing the truth in the case. One of the elements of such a model should be the empowerment of the judge with legal mechanisms that allow to realize the active participation in the process, since the judge is the person who administers justice.

Mr. A.I. Bastrykin also noted that any human activity in any field requires meaning. In the absence of a legal ideology, law enforcement activities are impossible, because the main task of law enforcement officers is to ensure an objective preliminary and judicial investigation. The Chairman of the IC of Russia also recalled the need to define justice as an absolute concept, in particular, in criminal law and criminal procedure, giving examples from his personal practice.

In conclusion, the Head of the Department stressed that the law must meet the current realities. The Chairman of the Investigative Committee once again outlined the need for the legal ideology formation, that will be applied in practice in modern conditions. “The world is changing and the law must change. And the philosophy of law should be more percise and more adapted to the realities of today!” - stated Mr. A.I. Bastrykin.

The Chairman of the Russian Investigative Committee also attended the plenary session of the forum dedicated to the issues of law in a multipolar world. As part of the event, there was a greeting speech of Mr. V.V. Putin  - the President of the Russian Federation, in which the President noted the importance of the declared topic and the need to develop a system of law based on the generally recognized principles of justice, equality and humanism. The meeting was also attended by Mr. D.A. Medvedev – the Deputy Chairman of the Security Council of the Russian Federation, he made a number of statements related to the formation of a new idea while maintaining the existing architecture of legal dogmas.

In addition, Mr A.I. Bastrykin took part in the work of the "Besogon (exorcist) and Law section", where the relationship between law and morality was discussed. Mr. A.K. Pushkov - the Senator of the Russian Federation, the Chairman of the Commission of the Federation Council of the Federal Assembly of the Russian Federation on Information Policy and Interaction with the Media, moderated that section. The speakers of the event were Mr. K.A. Chuychenko - Minister of Justice of the Russian Federation, Mr. N.S. Mikhalkov - the Honorary member of the Public Council under the Russian Investigative Committee, film director, People's Artist of the RSFSR. Speaking at the section, the Chairman of the Investigative Committee noted the importance of legal ideology as a science, which should be reflected in legislation. Mr. A.I. Bastrykin dwelled on the issues of upbringing and education of the younger generation separately, noting the significance and continuity of these processes. Participating in the discussion on issues of morality and ethics, the Chairman of the Investigative Committee of Russia gave examples from the practice related to the inhuman crimes commission against the civilian population of Donbas by Ukrainian military troops. The Head of the Body stressed that all persons involved will be prosecuted.

In the work of the section "Development of legal education in the Russian Federation" the above-mentioned topic of education was continued; Mr. N.M. Kropachev, the Rector of St. Petersburg State University, acted as a moderator. Among the participants of the event - Chairman of the Association of Lawyers of Russia Mr. S.V. Stepashin, Rector of the All-Russian State University of Justice (RPA of the Ministry of Justice of Russia) Ms. O.I. Aleksandrova, the Chairman of the Committee of the State Duma of the Federal Assembly of the Russian Federation on Science and Higher Education Mr.S.V. Kabyshev, First Deputy Minister of Justice of the Russian Federation Mr. E.L. Zabarchuk, the Dean of the Faculty of Law of St. Petersburg State University Mr.S.A. Belov, Rector of the Moscow State Law University named after O.E. Kutafin (MSUA) Mr. V.V. Blazheev, the Dean of the Faculty of Law, Lomonosov Moscow State University M.V. Lomonosova Mr. A.K. Golichenkov. It was claimed that the legal system constantly requires an influx of qualified legal personnel with a high level of professionalism and competence. In this regard, the emphasis is placed on the relevance of the problem of developing legal education in Russia in order to develop criteria and approaches to the training of lawyers directly for state and municipal authorities at all levels.

Recently, Mr. A.I. Bastrykin has already noted the importance of a return to the national education origin, which aroused keen interest and support of various online resources users. This was reflected in tens of thousands of views, comments and positive responses published in the Internet. Returning back to the claimed topic, the Head of the Investigative Committee noted that investigative work requires exceptional professionalism from the Officers of the Russian Investigative Committee, it requires strict observance of human rights and the principle of legality. In this direction, the most important basis of the worldview has to be formed and the theoretical training of the investigator is formed on a high-quality continuous education. The tasks facing the Investigative Committee of Russia today require the training of future investigators immediately from school. For this, the cadet corps and the boarding school for pupils is a part of the system of the Body, and the Academy of the Investigative Committee in is purposed to receive a specialized higher education. It is important not only to prepare future Officers well, but also to educate the patriotic youth having an active civic position,  a sense of empathy for other people's problems, justice, and the formation of the concepts of "honor" and "dignity" must be developed in them.

At the end of the meeting, the section participants identified the main vectors in the educational field that need to be improved, and there is also a need to a unified ideological baseto be formed in this direction.
