The evidence collected by the Investigating Authorities of the Main Investigation Directorate of the Investigative Committee of the Russian Federation for the city of Moscow was recognized as sufficient for adjudicating a verdict against Mr. Rabadan Magomedvaliev, Mr.Shamsutdin Dzhamalutdinov, Mr.Yusup Akhmedutdinov and Mr.Shamsutdin Mukhtarov on the basis of jury's conviction. Depending on the contribution of each, they were found guilty of crimes, prescribed in Part 2 Article 209 of the Criminal Code of the Russian Federation (gang activity), paragraphs «a, g, h» Part 2 Article 105 of the Criminal Code of the Russian Federation (murder of two persons committed by an organized group for hire, forced with robbery), Part 3 Article. 30 paragraphs. «а, g, h» Part 2 Article 105 of the Criminal Code of the Russian Federation (attempted murder of two or more persons, committed by an organized group for hire, forced with robbery), Part 3 Article 222 of the Criminal Code of the Russian Federation (ammunition trafficking, committed by an organized group), Part 3 Article 222.1 of the Criminal Code of the Russian Federation (illicit trafficking of explosive substances and devices, committed by an organized group).
According to the investigation and the court, between 2006 and 2013, the defendants, who were part of the organized criminal group called "Sharapovskie", committed a number of murders and other especially serious crimes in Moscow. At the same time, Mr. Magomedvaliev acted as a customer of the crimes and he directly financed the gang. Mr. Jamalutdinov organized the execution of crimes and provided the accomplices with weapons, while Mr. Akhmedutdinov and Mr. Mukhtarov were the crime committers. As an example, in 2006, Mr. Magomedvaliev had a conflict with a co-shareholder of one of the commercial organizations, resulting in the victim's refusal to increase Mr. Magomedvaliev's share of the profits received from the lease of the retail space. He turned to the master-mind of the gang to kill the victim for a monetary reward. In April 15, 2007, Mr.Akhmedutdinov and Mr.Mukhtarov tracked down the victim, who was on the way to his home, and Mr. Akhmedutdinov fired at least five shots at the victim. The crime took place near the entrance of an apartment building located along the Pyrieva Street in Moscow. The victim died at the scene, and the attackers fled. In 2007, the accessories to the crime committed a similar murder of a Moscow lawyer who also had an argument with Mr. Magomedvaliev.
The gang members carefully prepared for each crime. They spent time monitoring the victims first. After the crimes were committed, they carefully got rid of the cars used in crimes, the means of communication and the firearms involved, which allowed them to continue their criminal activities for a long time with impunity.
Between August and November, 2019 the gang members were detained on the territory of the Republic of Dagestan and in Moscow. During the searches, the Investigators and the operational services discovered a cache of firearms and grenades. The weapons were confiscated. All explosive items were subsequently deactivated and destroyed.
Earlier, other members of the gang, Mr. Kazbek Magomedov and Mr. Makhach Nurudinov, were convicted guilty of attempted murder for hire of a businessman in the capital of our country. The crime was ordered by Mr. Magomedvaliev. In July 13, 2022, in accordance with the verdict of the Moscow City Court, Mr. Magomedov was imposed the additional punishment as 14 years of custodial sentence for committing crimes prescribed in Part 2, Article 209 of the Criminal Code of the Russian Federation, Part 3, Article 222 of the Criminal Code of the Russian Federation and Part 3, Article 222.1 of the Criminal Code of the Russian Federation.
Currently, the investigation of the criminal case continues against the organizer of the gang group and against one of the masterminds behind the gang’s crimes. These individuals are put on the international wanted list. Investigation also identifies other members of the armed criminal group. Various episodes of their criminal activity are the subject to investigation.
In accordance with the verdict, Mr. Akhmedutdinov and Mr. Mukhtarov were sentenced to life imprisonment, Mr. Magomedvaliev was sentenced to 24 years in prison, and Mr.Jamalutdinov was sentenced to 22 years in prison.
