A criminal case is launched against the Ukrainian nationalists on loss of lives during the shelling of the Drama Theater building and the hotel in Donetsk

The Investigative Committee of Russia launched an investigation on the crime prescribed in Part 1, Article 356 of the Criminal Code of the Russian Federation (ill-treatment of the civilian persons, use of banned means and methods in warfare), against the Ukrainian nationalists, who shelled civilian infrastructure in Donetsk and killed people.

According to the investigation, on August 4, 2022, no later than 10:30 a.m., members of the Ukrainian armed formations, following the deliberately criminal orders of higher commanders and officials, carried out targeted artillery fire from heavy types of weapons with high damaging properties of civilian infrastructure in the Voroshilovsky raion of the Donetsk city, the Donetsk People's Republic.

As a result, the building of the Donetsk State Academic Music and Drama Theater “named after M.M. Brovun", the building of the hotel "Donbas Palace", two residential buildings located on Teatralny Avenue, were damaged, 5 civilians, including a juvenile, who were nearby the theater and the hotel, were killed, 6 more people were injured of varying severity.

The Ukrainian nationalists acted deliberately breaching the provisions stipulated in the Convention for the Protection of Civilian Persons in Time of War (Geneva, 08/12/1949), Additional Protocol II to it, having the aim of killing two or more persons, causing grievous bodily harm in a generally dangerous way to an unlimited number of civilians living in Donetsk People's Republic and not participating in the warfare, committed by a group of persons in collusion, on the grounds of political and ideological hatred and animosity.

The Investigative Committee of Russia is identifying the individuals from the Ukrainian armed formations for their subsequent prosecution, and the circumstances of the crime.
