The Chairman of the Investigative Committee of Russia holds a personal reception on the issue of providing medicines to seriously ill people

Mr. Alexander Ivanovich Bastrykin, Chairman of the Investigative Committee of the Russian Federation, held a reception of citizens in videoconferencing. It was attended by Mr. Eduard Valeryevich Kaburneev, First Deputy Chairman of the Investigative Committee of Russia, Heads of Units of the Main Directorate, Heads and Officers of Territorial Investigative Directorates.

The Head of the Department noted that in all regions, the largest number of citizens' appeals is related to untimely and inadequate medicine provision for people suffering from various diseases. At the reception, Mr. A.I. Bastrykin listened to the applicants from Volgogradskaya and Ulyanovskaya oblasts, and the Republic of Tatarstan. The persons who applied were the parents of children with serious illnesses who did not receive the medicines prescribed by law in full. Among the people who attended the reception were representatives of public organizations too.

The applicants' children from Volgogradskaya oblast suffer from type 1 diabetes mellitus (insulin-dependent) and are the subject to preferential provision of medicines and medical devices. At the same time, according to the applicants, the Officials of the Health Committee of Volgogradskaya oblast systematically breach the rights of their disabled children. Even though a number of citizens have court decisions, the necessary medicines and medical devices are not provided in full to them. In addition, the Applicants remarked, that there is a problem of not providing food for children on the first day of hospitalization, as well as the paid stay of parents of baby-patients in medical institutions, is also an outstanding one. Mr. A.I. Bastrykin listened to the report of Mr. V.I. Semenov, Head of the Investigative Directorate of the Investigative Committee of Russia for Volgogradskaya oblast. He reported on the progress of the criminal investigation launched on the fact of the negligence against the Officials of the Healthcare System in accordance with Part 1 of Art. 293 of the Criminal Code of the Russian Federation. The Head of the Department explained to his subordinates that problems of the mentioned matter require specific attention and urgent resolution. The Chairman of the Investigative Committee of Russia emphasized, that the Executive Officers of the investigative department should carefully monitor the Internet and track all appeals due to identify facts of breaching the rights of citizens and commission of malfeasance by officials, and it is also necessary to track the appeals related to possible thefts. Mr. A.I. Bastrykin ordered to submit an investigation plan of the mentioned above criminal case, so the implementation of which will be a subject to control in the Main Investigative Directorate.

The applicants from the Republic of Tatarstan also complained about the difficulties in obtaining medicines which are included to the list of essential virtual medicines. Taking into account the diagnoses, use of such medicines must be carried out in strict correspondence to the schedule, meanwhile any delays in taking them entail negative health consequences. However, the Officials of the Ministry of Health of the Republic of Tatarstan issue drugs late, blaming a lack of funding, so people in need of treatment are forced to buy everything at their own expense. One of the applicants also turned to the Head of the Office with a request to take the initiative and to reduce the time for registration of medicines in the Russian Federation, since today this procedure is long one and to much of laborious, while patients need the uninterrupted medication.

Another applicant from the Republic of Tatarstan told the Head of the Russian Investigative Committee that her 14-year-old daughter needed lifelong replacement therapy. However, originally the Regional Ministry of Health refused to provide the necessary medicine, after which the woman was forced to appeal to court, which took her side. At the same time, the court decision has not been executed for half a year, and the child is still not provided with the necessary consumables.

In addition, two citizens suffering from an orphan disease complained that they were also not provided with the necessary medicines, despite the avaliability of a court decision. On this fact, the investigating authorities of the Investigative Directorate for the Republic of Tatarstan launched a criminal case in accordance with Part , Article 293 of the Criminal Code of the Russian Federation (negligence) and Part 2, Article 315 of the Criminal Code of the Russian Federation (non-compliance with court decisions). The Head of the Department instructed Mr. V.A. Lipsky, Head of the Investigative Directorate of the Investigative Committee of Russia for the Republic of Tatarstan, to submit a detailed report on the consideration of citizens' appeals on the mentioned issue, as well as the progress-report of the criminal investigation.

The children of the applicants from Ulyanovskaya oblast suffer from type 1 diabetes mellitus (insulin-dependent), however, the Officials of the Regional Ministry of Health do not provide medical devices in full, as they are not included in the mandatory federal list; in addition, consumables have been replaced with their analogues, but the use of such analogues may lead to the loss of pump warranties, as the Applicants believe. Mr. S.Yu. Mikhailov, Head of the Investigative Directorate of the Investigative Committee of Russia for Ulyanovskaya oblast, reported on the launch of a criminal case in accordance with Part 1, Article 293 of the Criminal Code of the Russian Federation (negligence), and he reported on the measures taken to provide all sick children with the necessary products, taking into account medical indications.

The applicants also drew Mr A.I. Bastrykin's attention on the absence of such minor consumables as alcohol and alcohol wipes, which are necessary for disinfection during injection. It is noted that these aids were found in warehouses only after contacting the Investigative Committee of Russia.

Mr. A.I. Bastrykin instructed the Heads of the Territorial Investigative Directorates to organize personal receptions of citizens on the discussed issues on an ongoing routine basis. The Head of the Department also stressed that within the procedural inspections and criminal investigations, it is necessary to assess the legality of the allocation procedure and the procedure for spending budget funds for the mentioned above needs.

At the end of the personal reception, Mr. A.I. Bastrykin concluded, that the situation with the provision of medicines to seriously ill people is very acute. This refers to both: the regions of the Russian Federation that appealed today and to a number of other regions of Russia. In this regard, the Chairman of the IC of Russia turned to the Heads of Regions of the Russian Federation with a request to pay attention to today's problem and the need to take measures to eliminate bureaucracy and a formal approach in obtaining medicines for seriously ill children.
