The Chairman of the Investigative Committee of Russia holds a personal reception of citizens

Mr. Alexander Ivanovich Bastrykin, Chairman of the Investigative Committee of the Russian Federation, held a videoconferencing reception of citizens. It was attended by Mr. E.V. Kaburneev, First Deputy Chairman of the IC of Russia, Mr. S.N. Goryainov, Deputy Chairman of the Investigative Committee of Russia, Heads of Directorates of the Main Directorate, Heads and Officers of the territorial investigative divisions, who are investigating criminal cases that have become the subject to attention of the Head of the Department.

At the reception, Mr. A.I. Bastrykin listened to the applicants from the Tambovskaya oblast and Krasnodarskiy krai.

Thus, in July 2018, the 20-year-old daughter of the applicant from Tambovskaya oblast underwent a surgery to remove the palatine tonsils at the Tambov City Clinical Hospital No. 3. After the surgery, the girl had general physical health deterioration and she died. The applicant expressed her disagreement with the conclusions of the forensic medical examinations carried out within the criminal case, as they contradicted each other and did not determine a causal link between the actions of the doctors and the death of the patient.

Another resident of Tambovskaya oblast faced a similar trouble. According to her, the 42-year-old husband of the applicant felt unsatisfactory after the surgery to remove the tonsils in February 2020 at the Tambov City Clinical Hospital No. 3, but the man was released home and died soon. She believes that only unprofessional actions of doctors led to the death of her husband, who did not properly evaluate the patient's condition and in the presence of obvious circumstances did not reveal the existing pathologies and did not take emergency measures to provide him with the necessary medical care. In addition, she expressed her distrust to the conclusions of forensic medical examinations.

The Chairman of the Russian Investigative Committee listened to the report of Mr. A.N. Polshakov, Head of the Investigative Directorate of the Russian Investigative Committee for Tambovskaya oblast. He explained that criminal cases were launched on both facts in accordance with Part 2, Article 109 of the Criminal Code of the Russian Federation (infliction of death by negligence), which were filed into one proceeding. The Chairman of the Investigative Committee of Russia criticized his subordinates for delaying the investigation. He instructed to appoint additional forensic medical examinations for both cases and conduct them in institutions of Moscow or St. Petersburg. An internal inspection has been scheduled for the officers involved in the investigation. All files of the criminal case will be transferred to the Main Investigative Directorate of the Investigative Committee of Russia for the appraisal.

Then the Head of the Russian Investigative Committee listened to a married couple from Krasnodarskiy krai. In February 2021, their newborn baby started vomiting at home and cried constantly. The parents sought medical help at the Temryuk Central District Hospital, but the child died. The applicants noted bureaucratic dysfunction in the investigation of the criminal case at the local level. Mr. A.K. Maslov, Head of the Investigative Directorate of the Investigative Committee of Russia for Krasnodarskiy krai, reported that a criminal investogation was launched in accordance with Part 2, Article 109 of the Criminal Code of the Russian Federation (infliction of death by negligence), and now the file is sent for the approval of the indictment. The Chairman of the Russian Investigative Committee imposed a control over mentioned situation to the Main Investigative Directorate. Mr. A.I. Bastrykin instructed Mr. A.K. Maslov to submit an urgent report on the progress of the investigation, as well as to provide a general info on the situation in Krasnodarskiy krai regarding the violation of people's rights to quality medical care.

At the end of the reception, Mr. A.I. Bastrykin gave a number of instructions to the Main Forensic Directorate (Forensic Center) of the Investigative Committee of Russia and the Forensic Expert Center.
