The evidence collected by the Main Investigation Directorate of the Investigative Committee of the Russian Federation was recognized as sufficient by the court for sentencing Ms. Anna Andrianova, manager of the "Jump" fitness club in Moscow. She was found guilty of committing a crime prescribed in Article 238 of the Criminal Code of the Russian Federation (providing services that do not meet safety requirements, inflicting the death of a person).
The investigation and the court established that on September 22, 2020, Ms. Konkina began to drown while swimming in the pool of the "Jump" fitness club. According to the investigation, the death of the victim occurred in a medical facility two days later, because there were no medical personnel in the club, there was no on-duty swimming instructor, and medical assistance was not provided in time.
Ms. Anna Andrianova, the Founder and Manager of "Jump" Fitness Club LLC, was imposed a preventive restraint as a ban on certain actions.
To secure the civil claim filed by the victim, Mr. Konkin, the defendant's property worth 11 million rubles was arrested.
A number of examinations were carried out during the criminal investigation, including two complex commission medical examinations, numerous witnesses and specialists were interrogated, and other investigative actions were carried out confirming Andrianova's involvement.
The court sentenced Ms. Andrianova to two years of compulsory labor.
