The Chairman of the Investigative Committee of Russia holds a personal reception of citizens

Mr. Alexander Ivanovich Bastrykin, Chairman of the Investigative Committee of the Russian Federation, held a reception of citizens in the way of video conference. It was attended by Mr. E.V. Kaburneev, First Deputy Chairman of the IC of Russia, Mr. S.N. Goryainov, Deputy Chairman of the Investigative Committee of Russia, heads of units of the Main Directorate, as well as Heads and Officers of the territorial investigation divisions, whose criminal cases have become the subject to attention of the Head of the Department.

At the reception, Mr. A.I. Bastrykin listened to the applicants from the Khanty-Mansiysk Autonomous Okrug-Yugra and Perm Krai.

Thus, the applicant from Khanty-Mansi Autonomous Okrug-Yugra reported, that in August 2021, her 18-year-old son applied to the Nizhnevartovsk City Dental Clinic with complaints on redness in the tooth area, as well as swollen lymph nodes. Based on the results of a medical examination by a dentist, a decision was made to remove the tooth, the surgery was performed at the same day. However, the patient's condition worsened, he was hospitalized and died in September 2021. The applicant expressed her concern about the duration of the forensic medical examinations, as well as the progress of the criminal investigation launched in accordance with Part 2, Article 109 of the Criminal Code of the Russian Federation (Infliction of Death by Negligence).

Another applicant from Khanty-Mansi Autonomous Okrug-Yugra reported that in January 2021, during an urgent delivery at the Nizhnevartovsk District Clinical Perinatal Center, the fetus died. She does not agree with the conclusions of the forensic medical examination, which did not establish the guilt of the doctors, and she believes that the criminal case launched on the offense prescribed in paragraph "c" of Part 2, Article 238 of the Criminal Code of the Russian Federation (the provision of services that do not meet security requirements), is being investigated improper and the bureaucratic dysfunction takes place too.

Mr. A.I. Bastrykin listened to the report of Mr. M.V. Mokshin, Head of the Investigative Directorate of the Investigative Committee of Russia for the Khanty-Mansiysk Autonomous Okrug-Yugra. The Head of the Investigative Committee of Russia noted the unsatisfactory work of his subordinates in the investigation of both criminal cases, including the work related to forensic medical examinations. All Officers involved in the investigation have been subject to an internal inspection. A procedural inspection has also been appointed in relation to the investigator in whose proceedings these criminal cases are located. Mr. A.I. Bastrykin instructed the Main Investigation Directorate of the Russian Investigative Committee to study the files of criminal cases and to make the mentioned above criminal investigations a subject to control in the Main Directorate of the Department. The Forensic Expert Center of the Investigative Committee of Russia was instructed to get involved in the issue of conducting an additional forensic medical examination in institutions of Moscow or St. Petersburg.

The Head of the Russian Investigative Committee also listened to the applicants from the Perm Krai. They said that their 26-year-old son was undergoing outpatient treatment in Polyclinic No. 3 of the Tchaikovskaya Central City Hospital due to deterioration in health in October 2021. Then he was taken to the Tchaikovskaya Central City Hospital by an ambulance. During surgery, doctors discovered a spontaneous rupture of the spleen of the patient, as a result of which he died. The parents informed the Head of the Investigative Committee of Russia that the criminal case was launched out of time. However, even now, according to the applicants, the investigation is conducted in an improper manner. They also disagree with the conclusions of the forensic medical examination, which did not establish a causal connection between the actions of doctors and the death of the patient. The applicants asked the Head of the Russian Investigative Committee to appoint an additional examination in a medical institution of St. Petersburg.

Mr. D.V. Golovkin, Head of the Investigative Directorate of the Investigative Committee of Russia for Perm krai, reported that a criminal investigation had been launched on the offense of a crime prescribed in Part 2, Article 109 of the Criminal Code of the Russian Federation (Infliction of Death by Negligence). The Head of the Russian Investigative Committee criticized his subordinates for the untimely launching of a criminal case and the long investigation. An internal inspection has been scheduled for a number of Officers of the territorial subdivision. The Main Investigation Directorate of the Investigative Committee of Russia was instructed to study the files of the criminal case. In addition, the Forensic Expert Center was instructed to organize a forensic medical examination at the Army Medical Academy named after S.M. Kirov in St. Petersburg, with which the Investigative Committee has a cooperation agreement.

At the end of the personal reception, Mr. A.I. Bastrykin noted the need for a more thorough approach to the issue of forensic medical examinations, including the timing of their conduct. In addition, a number of instructions were given to the Officers of the Directorate of the Investigative Committee of Russia and the Main Forensic Directorate (Forensic Center) of the Investigative Committee of Russia.

"We are Officers of the Investigative Committee, and we must adhere to the principle of independence within the criminal investigation in the field of medicine, including the matters of appointing forensic medical examinations, the conclusions of which determine the further stream of the investigation and the protection of the rights of victims who have lost their relatives," - summed up Mr. A.I. Bastrykin.
