The Chairman of the Investigative Committee of Russia holds a personal reception of citizens

Mr. Alexander Ivanovich Bastrykin, Chairman of the Investigative Committee of the Russian Federation, held a reception of citizens. The reception, held via videoconference, was attended by Mr. Eduard Valeryevich Kaburneev, First Deputy Chairman of the IC of Russia; Mr. Nikolai Vladimirovich Ushchapovsky, Deputy Chairman of the Russian Investigative Committee; Heads of a number of Divisions of the Main Directorate, as well as the Authorities of the Eastern and Western Interregional Investigative Directorates for transport.

The Head of the Investigative Committee of Russia listened to the Applicants who turned to him in connection with incidents occurred at transport facilities.

The Applicant from Kaliningrad Oblast worked as a sailor on a fishing vessel in the Sea of Okhotsk. In January 2020, he injured his arm in an accident, which was subsequently amputated. The Applicant confidently stated that if he had been taken to a medical facility in a timely manner by helicopter, the doctors would have been able to save his arm, however, according to the Applicant, the Captain did not provide appropriate conditions, and the doctor on the vessel did not properly assess the condition of the injured victim.

Mr. A.A. Alexandrov, Head of the Eastern Interregional Investigative Directorate for Transport, reported on the progress of the crimnal investigation (Part 1, Article 216 of the Criminal Code of the Russian Federation - violation of safety rules) launched against the ship's Chief Engineer, which is now being considered by the court. Also Mr. A.I. Bastrykin heard arguments in connection with the termination of the criminal case on the fact that a sailor who received an industrial injury was left in danger (Article 125 of the Criminal Code of the Russian Federation), and he was dissatisfied with the work of his subordinates. On the motion of the Head of the Department, the criminal case was transferred to the Main Directorate of the Investigative Committee of Russia for the further investigation. The Head of the Department also instructed to submit a detailed report on the investigative progress on both criminal cases. An internal inspection has been appointed against the Senior staff and Officers of the Territorial Transport Unit, in whose proceeding these criminal cases were. Mr. A.A. Reichert, Acting Head of Primorsky Investigative Division for Transport of the Eastern Interregional ID for Transport, was suspended from his duties for the internal inspection duration term.

The Applicant's father from Moscow was killed in a collision between his small boat and a dry cargo ship in the Barents Sea near Maly Oleniy Island in Kolskiy Raion of Murmansk Oblast. This happened in May 2021. Mr. P.S. Vymenets, Head of the Western Interregional Investigative Directorate for Transport, reported on the progress of the criminal investigation launched in accordance with Part 2, Article 263 of the Criminal Code of the Russian Federation (violation of traffic safety and operation rules). Mr. A.I. Bastrykin instructed to finalized the investigation promptly and submit the criminal case for consideration by the court. It was instructed to prepare a report on the progress of the investigation.

A resident of Moscow Oblast represented the interests of an activist group of people whose relatives, including the Applicant’s son, died between 2017 and 2021 at a railway crossing at the Kupavna station of the Gorky direction of the Moscow Railway. Juveniles were among the dead too. The Applicant noted that pedestrian crossings on this section of the road were unregulated, but his appeals on this matter to the relevant Authorities, including the Investigative Authorities of the Western Interregional Investigative Directorate for Transport, were not efficient.

Mr. A.I. Bastrykin listened to the report of Mr. P.S. Vymentz for all the above incidents related to the death of people. The Head of the Department noted the inefficient activities of his subordinates and instructed to conduct an internal inspection of the Transport Unit on the issues of work and the adoption of procedural decisions. Based on the results of the inspection, all appropriate personnel decisions will be made if there are any grounds. Mr. Bastrykin instructed to transfer all files related to mentioned above cases to the Main Investigative Directorate of the Russian Investigative Committee for the purpose of the most complete, objective and comprehensive investigation into the death of people.

Following the results of a personal reception, the Chairman of the Investigative Committee of Russia gave a number of instructions to the relevant Divisions of the Main Directorate of the Department, including the instruction to present an analysis of the effectiveness of Transport Investigative Units activities for further decisions.
