The Chairman of the Investigative Committee of Russia holds a personal reception of citizens

Mr. Alexander Ivanovich Bastrykin, Chairman of the Investigative Committee of the Russian Federation, held a reception of citizens. The following persons were present at the personal videoconferenc reception: Mr. Eduard Valeryevich Kaburneev - First Deputy Chairman of the IC of Russia; Mr. Sergey Nikolaevich Goryainov - Deputy Chairman of the IC of Russia; Acting Deputy Chairman of the Investigative Committee of the Russian Federation - Head of the Main Military Investigative Directorate Mr. Konstantin Evgenievich Korpusov; Heads of a number of divisions of the Main Directorate, as well as the Leadership of Territorial Investigative Bodies.

The Head of the Investigative Committee of Russia listened to the Applicants from the Republic of Bashkortostan, Saratov and Moscow Oblasts.

The Applicants from the Republic of Bashkortostan represented the interests of an activist group of large families and families with disabled children. Within the Federal Project's implementation in 2014, they were granted with land allotments. However, in their opinion, the approach to the allocation of plots was of a formal nature, the land provided to them is unsuitable for habitation. There are no transport and social infrastructures, and communications have not been introduced in the Elkibaevo and Samokhvalovka settlements, which are part of the Ufa city. The situation with medical drug and care provision is a subject to concern. The remoteness of the polyclinic and the lack of equipped vehicles complicate visits to specialists and impede the full and regular implementation of rehabilitation activities. Systematic power outages also violated the Applicants' rights to comfortable living conditions. In addition, according to the Applicants, they were unreasonably limited in terms of gasification. Appeals of citizens to various Authorities have not yielded results. Local Self-Government, Executive Authorities, as well as Supervisory Authorities remain indifferent to the problems of these families, and therefore they are forced to eliminate the existing shortcomings at their own expense and, to the best of their ability, participate in creating more favorable conditions for the living and movement of disabled children.

Colonel of Justice Ilyas Gabdulkhakovich Masallimov, Acting Head of the Investigative Directorate of the Investigative Committee of Russia for the Republic of Bashkortostan, reported that on November 11, 2022, a criminal case was launched in accordance with Part 1, Article 293 of the Criminal Code of the Russian Federation (negligence). However, the Prosecutor canceled this decision and it is currently being appealed. In this regard, the Chairman of the Investigative Committee of Russia instructed to immediately re-launch a criminal case on the above indicated facts with a view to subsequently resolving the issue of bringing to justice the Officials of the Authorities who failed to perform or improperly performed their duties, which led to a significant violation of the rights and legitimate interests of citizens.

Large families in Saratov Oblast faced similar problems. They were also allocated land plots unsuitable for habitation due to the lack of utilities. The Applicants announced their expenses for the creation of a favorable living environment, noting that such work should be financed from the budget, in accordance with the current legislation.

Colonel of Justice Anatoly Yuryevich Govorunov, Head of the Investigative Directorate of the Investigative Committee of Russia for Saratov Oblast, reported on the progress of the criminal investigation launched in accordance with Part 1, Article 293 of the Criminal Code of the Russian Federation (negligence). After listening to the report, Mr. A.I. Bastrykin noted the need for a comprehensive solution to the problems of citizens and instructed to transfer the mentioned criminal case to the proceeding of the more experienced Investigators of the Regional Investigative Directorate.

The Applicants from Moscow Oblast are the parents of children with disabilities who need technical means of rehabilitation. The women noted that the Moscow regional branch of the Social Insurance Fund of the Russian Federation concludes state contracts with unscrupulous suppliers, in violation of the law. At the same time, the quality of the services provided for the manufacture of rehabilitation means is at a very low level, and the cost of work is greatly inflated. One of the women who applied for the reception also complained about the inaction of responsible Officials in connection with the family living in emergency conditions.

Major General of Justice Alexander Yuryevich Starikov, Head of the Main Investigative Directorate of the Investigative Committee of Russia for Moscow Oblast, reported on the progress of the criminal investigation launched in accordance with Articles 238, 293 of the Criminal Code of the Russian Federation (performance of work or provision of services that do not meet safety requirements, negligence). The Chairman of the Investigative Committee instructed to immediately re-launch a criminal case on similar grounds, in connection with the cancellation of the decision to launch a criminal case prescribed in Article 293 of the Criminal Code of the Russian Federation. The Head of the Depatrment stressed that the position of the Russian Investigative Committee is unchanged and these facts of violations of the rights of citizens are subject to investigation and legal assessment.

Mr. A.I. Bastrykin instructed the Heads of the Territorial Investigative Bodies, who were present at the meeting, to prepare files containing the problems presented by the Applicants, for subsequent information of the Heads of the above-mentioned regions.

As a result of the personal reception, the Chairman of the IC of Russia also gave a number of instructions to the Heads of the relevant Directorates of the Main Directorate of the Department.
