The Chairman of the Investigative Committee of Russia holds a personal reception of citizens living in emergency housing

Mr. A.I. Bastrykin, Chairman of the Investigative Committee of the Russian Federation, received citizens via video conference. The personal reception was attended by: Mr. Eduard Valeryevich Kaburneev - First Deputy Chairman of the Investigative Committee of Russia, Mr. Sergey Nikolaevich Goryainov - Deputy Chairman of the Investigative Committee of Russia, Heads of a number of Divisions of the Main Directorate, as well as the Authorities of Territorial Investigative Directorates.

The Head of the Department listened to the applicants from Kurgan and Lipetsk Oblasts.

Since 2009, residents of Kurgan Oblast have been living in an uninhabitable apartment building, which was recognized as emergency only in 2017, and as a subject to demolition and resettlement. However, residential premises have not yet been provided to residents of 36 apartments, since the decision to recognize the house as emergency was made untimely by local authorities, which did not allow this house to be included in the next program for the resettlement of citizens from emergency housing stock for 2019-2025. At the same time, living in such a house creates a constant threat to both the residents and passers-by.

Mr. B.V. Francishko, Head of the Investigative Directorate of the Russian Investigative Committee for Kurgan Oblast, reported that the procedural inspection was initiated immediately after the citizens applied for the restoration of their rights and legitimate interests. Based on its results, a criminal case was launched in accordance with Part 1, Article 293 of the Criminal Code of the Russian Federation (negligence) against the Officials of the Kurgan city Administration.

At the reception, it was found that the mentioned case is not an isolated one, in connection with which Mr. A.I. Bastrykin instructed to launch a criminal case and create an investigation team to investigate similar facts of negligence of responsible Officials in the implementation of programs for the resettlement of citizens from emergency housing stock in Kurgan Oblast.

The Chairman of the Russian Investigative Committee instructed to schedule a second meeting with citizens who applied for the reception in a month.

The appeal of the following applicants, residents of the Lebedyan city, Lipetsk Oblast, was revealed during the media and social networks monitoring by the Investigative Committee of Russia Officers. The applicants stated that they lived in an emergency building, where the electrical wiring was faulty, bricks from the outer masonry were falling out, and mold had appeared on the walls due to dampness. In 2016, a major overhaul of the house was allegedly carried out at the expense of the Regional Overhaul Fund, but living in it still poses a threat. In addition, the citizens explained that the Investigating Authorities had repeatedly refused to launch a criminal case.

The report of Mr. E.V. Shapovalov, Head of the Investigative Directorate of the Investigative Committee of Russia for Lipetsk Oblast and Mr. A.V. Fursov, Acting Head of the Chaplyginsky Interdistrict Investigative Unit of the Investigative Directorate of the Russian Investigative Committee for Lipetsk Oblast.

The Head of the Department gave a negative assessment of his subordinates work, pointing out the personal responsibility of Officials when considering applications from citizens.

To date, a criminal case has been launched in accordance with Part 1, Article 293 of the Criminal Code of the Russian Federation (negligence) against the Officials of the District Administration. Mr. A.I. Bastrykin instructed to make this investigation a subject to control the Main Directorate of the Investigative Committee of the Russian Federation.

Residents of two houses in Zadonsky raion, Lipetsk Oblast faced similar problems, they turned to Mr. A.I. Bastrykin also through social media. Living in dilapidated emergency housing threatens people not only with the collapse of roofs from snow, but also causes diseases due to the low temperature in buildings; house depreciation is 79%. These houses were recognized as emergency in 2020 and the houses were recognized as subject to demolition, however, such decisions were made by the local administration untimely, and they did not allow the houses to be included in the next resettlement program, the situation is similar to that discussed above in Kurgan Oblast. Mr. D.A. Kleshchin, Head of the Terbunsky Interregional Investigative Unit of the Investigative Directorate of the Investigative Committee of Russia for Lipetsk Oblast, reported that a criminal case had been launched against officials of the District Administration in accordance with Part 1, Article 293 of the Criminal Code of the Russian Federation (negligence).

At the same time, Local Authorities proposed a solution to this problem by buying apartments in an emergency building from citizens for their further purchase of new housing.

At the end of the reception of applicants from Zadonsky raion, Lipetsk Oblast, Mr. A.I. Bastrykin instructed to submit a progress report on the criminal investigation, as well as on the implementation of the plan proposed by the Administration for the resettlement of citizens from emergency housing and the payment of funds for the further purchase of apartments.

Following the results of the personal reception, the Chairman of the Investigative Committee of Russia emphasized that the Investigating Authorities should work to prevent negative consequences in matters related to emergency houses, and proactively monitor all cases of non-fulfillment of programs for the resettlement of citizens from emergency housing stock.

Also Mr. A.I. Bastrykin instructed to inform the Heads of the mentioned above regions about the existing problems, indicating the need for urgent resettlement of residents in safe living conditions.
