Ex Deputy Chief of pre-trial prison where Magnitsky was held to appear in court

The Main Investigations Directorate of the Russia’s Investigative Committee has finished investigation of a criminal case against former Deputy Medical Chief of Federal Budgetary Institution IZ-77/2 of the Federal Penitentiary Service Directorate of the Russian Federation, Moscow pre-trial prison Dmitry Kratov. He is charged with a crime under part 2 of article 293 of the RF Criminal Code (neglect of duty entailing by negligence death of a person).

According to investigators, Kratov did not properly discharge his professional duties in providing medical assistance to the detainees. As a result, in 2009 this caused the death of arrested Sergey Magnitsky.

Investigators have collected sufficient evidence, therefore the case with the approved indictment is sent to the court to be tried on the merits.

The criminal case against Dmitry Kratov had been separated from the major criminal case over death of Sergey Magnitsky over which investigation and procedural operations are still under way to establish all circumstances of the man’s death and other circumstances that can be relevant for lawful and well-grounded decision including evaluation of actions by certain officials of Federal Penitentiary Service Directorate, Ministry of Internal Affairs and others. Due to necessity of large amount of investigation and procedural operations including forensic expertise, the investigation of the criminal case is to be continued.
