In Kabardino-Balkarian Republic, former acting Mayor of Nalchik is suspected of bankruptcy misconduct

Investigating authorities of the Investigative Committee of the Russian Federation in the Kabardino-Balkaria launched the criminal case against the former Acting Mayor of Nalchik, Leonid Hamgokov. He is suspected of having committed an offense under Part 1 of Art.195 the RF Criminal Code (illegal actions in bankruptcy).

According to investigators, in 2007 Hamgokov, as the acting head of the local administration of Nalchik, and knowing that the Arbitration Court of the Republic has introduced a procedure for monitoring in relation to one of the municipal bankrupt enterprises of Nalchik, issued a decree transferring the management of bankrupt’s assets to another municipal enterprise on the basis of the right of economic management. Pursuant to the specified regulation, in 2007, capital assets amounted to 2.9 billion rubles, including 284 non-residential premises of the residual value of more than 49.3 million rubles, which, in accordance with the current legislation could compose the debtor’s bankruptcy estate, were removed from the balance and transferred to another municipal enterprise. Later, in terms of the inability to restore the solvency of the enterprise and a significant excess of the credit debts of its assets, the court recognized the enterprise as a bankrupt and opened bankruptcy proceedings. Thus, Hamgokov improperly transferred the management of the assets of the bankrupt enterprise of the residual value of more than 49.3 million rubles to one of the municipal enterprises, which led to a reduction of the debtor’s bankruptcy estate and caused the main creditor - IFTS of Russia in Nalchik – a damage in the amount of more than 43 2 million rubles.

At present, investigation and operational-search measures aimed at establishing all the circumstances of the offense are being taken. The criminal investigation continues.
