Criminal investigation launched into frauds with selling Mosvoyentorg building

The Central Military Investigations Directorate of the Russia’s Investigative Committee has launched a criminal case against officials of Property Relations Department of the Defense Ministry of the Russian Federation and top managers in affiliated controlled companies of OAO Oboronservis and outside commercial organizations. The case was opened over signs of crimes under part 3 of article 285 (abuse of official powers entailing serious consequences), part 2 of article 201 (abuse of authority entailing serious consequences) and part 4 of article 159 of the RF Criminal Code (swindling committed by an organized group of persons or on an especially large scale). It concerns selling of real estates of OAO Mosvoyentorg (OJSC) – a non-residential building at the address: 21/1, Arbat, Moscow.

We remind that the opened joint-stock company Mosvoyentorg was established on 15 September 2008, in accordance with the Presidential Decree. The Russian Federation invested shares of OAO Mosvoyentorg as a contribution to an authorized capital of OAO Oboronservis.

In accordance with instructions of the former Ministry of Defense the deals related to disposal of real estate of organizations of OAO Oboronservis were implemented with compulsory reconciliation with Property Relations Department of the Defense Ministry.

In the period between April and December 2011, officials of this department and top managers of OAO Voyentorg (OJSC) and OAO Mosvoyentorg, using their powers and together with a founder and CEO of OOO Center of Legal Support Expert (LLC) Y. Smetanova and managers of its subsidiary OOO VitaProject (LLC), carried out a number of consecutive actions to steal money from OAO Mosvoyentorg and to sell the building in Arbat at lower price.

Namely, on 1 September 2011, an agreement on evaluation of the abovementioned building was concluded between Mosvoyentorg and Center of Legal Support Expert. Smetanova organized the evaluation at lower price – the building was evaluated at 115 million rubles, while its market price at the moment of purchase transaction was at least 140 million rubles.

In addition officials of Property Relations Department of the Defense Ministry and top managers of OAO Oboronservis and outside commercial organizations, in the period between April 2011 and January 2012, while concluding and paying for an additional agreement to one of the contracts stole from Mosvoyentorg 2.8 million rubles.
