In Moscow Region owner of dog that bit child to stand trial

The investigating bodies of Moscow Region Main Investigations Directorate of the Russia’s Investigative Committee have finished investigating a criminal case against a 55-year-old resident of Podolsk District charged with inflicting grievous bodily harm to a child by negligence (part 1 of article 118 of the RF Penal Code).

According to investigators, in the period between 2008 and 2010 the accused lived in a single-family dwelling in the village of Ordyntsy together with his family and two dogs, which he held on the adjacent piece of land. One of the dogs, a Caucasian Shepherd named Rex, was aggressive and had never been trained.

Being aware of the features of the breed and the nature of his dog the accused ignored all possible rules and conditions set for holding such dogs. The dogs ran around freely unleashed and unmuzzled while the owner had no control over their behavior or whereabouts. The accused was well aware that his dogs ran freely around the area, several times jumped over the fence or ran out the open gate and were very aggressive towards people outside.

On 18 August 2010, in the evening, at the moment when a small son of the accused was pulling a bicycle through the gate, the shepherd ran outside and attacked an 8-year-old girl that was riding a bike nearby. The girl sustained multiple bites. The harm was qualified as grievous bodily harm.

Though during an initial investigation the accused did not entered a guilty plea, the investigators have gathered enough evidence, so the criminal case with the approved indictment will soon be sent to court to be tried on the merits.
