Criminal investigation launched into negligence of officials in Russian Federal Service for Registration, Cadaster and Cartography

The Central Federal District Investigations Directorate of the Russia’s Investigative Committee has finished the check based on the appeal of the Chairman of the chamber of Account about violations in spending the funds allocated to the Federal Service for Registration, Cadaster and Cartography (hereinafter Rosreestr) to implement federal subprogram “Creation of real estate cadaster (2006-2012)”. A criminal case has been opened following the check into signs of a crime under part 1 of article 293 of the RF Penal Code (negligence).

It has been found that 52.8 billion rubles were allocated for the subprogram, of which 42.8 billion is from the federal budget. The program provided for creation of the state real estate register system in the Russian Federation, including introduction of automated information system of state real estate cadaster; provision of filling the real estate cadaster with information on real estates; organization of access to the cadaster of state authorities and local governments, organizations and citizens and building a tax base to levy land and property taxes. The state hirer and developer of the subprogram was Rosreestr, which also executed the current management of the actions and coordinated their progress.

In the period between 2009 and 2011 the officials of Rosreestr concluded a number of state contracts with different organizations with a total sum no less than 23.8 billion rubles. But part of the contracts, which budget money was spent on, did not comply with aims and tasks of the subprogram. In addition, part of the contracts were concluded to implement the subprogram, however the officials of Rosreestr did no control the progress of work and did not organize the work of commissions to accept the executed work. This entailed discrepancy between the executed work and the subject of the contracts. The works were paid for while there were no results of the work under the contract.

This way for example under one of the state contracts it was necessary to make a cartographic base of the state real estate cadaster reflecting data on the borders of pieces of lands, parts of them, outlines of buildings, constructions, unfinished buildings, borders between the units of cadastral division of the territory of the Russian Federation, borders between municipalities and settlements. The executed work was accepted and paid for, but it has been found that the documents and reports accepted by Rosreestr did not meet the requirements state contract specification, including the paragraph providing that the satellite photography should be made when there is no snow. It has been found that the number of snow covered satellite images constitutes 272.2 thousand square kilometers, therefore they should be replaced, which requires additional funds about 10 million rubles.

During the probe the investigators are going to check the circumstances each state contract was signed in and qualify the actions of the officials and executors of the work under the contracts.
