In Tomsk Region sentence passed upon child care provider guilty of negligence

A court has recognized the evidence gathered by Tomsk Region investigating bodies of the Russia’s Investigative Committee sufficient to convict a child care provider of day nursery 46 in the city of Tomsk found guilty of a crime under part 2 of article 293 of the RF Penal Code (negligence entailing death of a person).

The court and investigators have found that in the evening of 14 August 2014, the child care provider of day nursery No 46 in the city of Tomsk while being on a walk with children at a children’s playground failed to execute her duties when did not take any measures to protect life and health of a three-year-old girl and left her unattended. As a result of the woman’s criminal inaction the girl was kidnapped from the nursery by a resident of Tomsk. Her dead body was later found with signs of violent death in Pyatoy Armii street in Tomsk.

During the probe the investigators carefully studied the circumstances that contributed to the crime. Requests to identify those circumstances were sent to the Governor of Tomsk Region, head of Education Department of Tomsk Region and head of Education Department of Tomsk. Following the requests officials of administrations of Tomsk Region and the city of Tomsk took a number of measures to ensure security of educational facilities in the region. Namely, they developed a program to check how well education officials know their professional duties, requirements put forward for those working with children, actions in case of threats to children’s security and a list of basic actions (instruction) of personnel of educational organizations in case of emergency situations. There is a plan of drills and briefings of personnel of educational institutions in case of threats to security. A working group was set up to develop measures of security in educational institutions of Tomsk Region. Measures were taken to check security level of children day care facilities. Funds were allocated from Tomsk budget to enhance security measures in preschool day care facilities. A decree of Tomsk administration approved municipal program Safe City for 2015-2017 aimed at enhancing security and among other measures includes repairs of fences around preschool day care facilities, installation of access control systems, CCTV cameras, lighting of premises of preschool day care facilities.

Administration of Tomsk Region allocated money from the reserve fund for financing contingencies to repair the fence around day care No 46 from which the child was kidnapped.

During the preliminary investigation the accused pleaded guilty in court. The court has sentenced her to 4 months of public work and banned from taking positions in child care for two years.
