In Samara Region CEO of ZAO Amusement Park charged with unsafe services entailing death of child to stand trial

Samara Region investigating bodies of the Russia’s Investigative Committee have finished investigating a criminal case against CEO of ZAO Amusement Park charged with a crime under paragraph “c” of part 2 of article 238 of the RF Penal Code (provision of services that do not meet life and health safety entailing death of a person by negligence).

According to investigators, in the period between 10 May and 1 June 2012, the accused employed stuff to work at a family swimming pool Aqua Funny, approved terms of use and job descriptions, but failed to agree them with the center of the Federal Service for Surveillance of Consumers’ Rights and Human Wellbeing or entrust the stuff with duty to control observance of the terms of use of the swimming pool and did not include there special safety rules for children under 7 years of age. The accused disregarded safety requirements and did not have an operation document for the attraction which would contain information on behavior, terms of use and limitation, but still provided the unsafe services. As a result of those violations on 14 June 2012, between noon and 12:30 PM, a 6-year-old boy dived in the pool while his parents and the staff were not around. The child had no protection means on him and could not swim. The boy drowned.

The investigators have gathered enough evidence, so the criminal case with the approved indictment has been sent to court to be tried on the merits.
