In Omsk during investigation in traffic accident killing 16 another investigation launched in negligence of officials of State Road Control Service and director of passenger enterprise detained

During an investigation in the large traffic accident the Omsk Region investigative bodies of the Russia’s Investigative Committee have launched an investigation against unidentified officials of Omsk Region Office of the State Road Control Service over a crime under part 3 of article 293 of the RF Penal Code (negligence, that is failure or neglect to the duty due to careless attitude to service if it entailed by negligence death of two or more people).

The investigators have revealed that the officials of Omsk Region Office of the State Road Control Service who were responsible for control and surveillance over motor vehicles and roads, during check were aware about violations of labor discipline at passenger enterprise No 4, but failed to adequately respond to gross violations of the law due to their neglect of their service.

At present, investigative operations are underway to find out all the circumstances of the crime and identify the officials to be prosecuted for it.

Besides investigation is continued in the criminal case opened by the Omsk Region investigating bodies of the Russia’s Investigative Committee in a crime under part 3 of article 238 of the RF Penal Code (providing services that do not meet health and life safety standards entailing death of two or more people) following a traffic accident that happened in the suburb of Omsk on 24 June 2015.

According to investigators, the bus owned by the municipal passenger enterprise that provided transportation services to OAO Siberian Poultry Factory under an agreement, was carrying workers of the factory. On the 20th kilometer of Omsk – Nizhnyaya Omka highway it took the wrong side of the road and collided with a KAMAZ-5410 with a semi-trailer loaded with bricks. The traffic accident claimed lives of 16 people, including the drivers, and 11 more passengers were injured.

The investigators revealed gross violations of labor law and passenger transportation safety rules that had taken place at the enterprise. Because of that, Alexander Chertolyas, Director of the enterprise was detained on suspicion of a crime under part 3 of article 238 of the RF Penal Code.

The investigators believe that the director of the passenger enterprise who was in charge of arranging for the passenger transportation safety requirements to be met and personal control over compliance with those requirements and labor law, had failed to fulfill his duties properly and did not ensure that passenger transportation safety requirements and labor law were followed or proper control over health of drivers.

As a result of his wrongdoings, the enterprise did not followed working schedule and respite norms set out by the Russian laws and ministerial acts. The drivers often worked extra hours and did not have enough time to have rest and restore.

This way, according to investigators, the driver of the bus that carried the workers of the poultry factory, had been driving over 12 hours on the day of the accident and had had no rest for a long time. He might have taken the wrong side of the road and collide with the truck because of tiredness and possible lower concentration.

The investigators are going to ask the court to remand the suspect in custody.
