Evidence collected by the Main Investigation Directorate of the Investigative Committee of the Russian Federation for the city of Moscow was recognized by the court as sufficient for issuing a verdict against Mr. Bagaudin Kostoev, Mr. Ali Belkhoroev and Mr. Batyr Tumgoev on the basis of a guilty verdict by a jury. Depending on the role of each, they were found guilty of committing crimes prescribed in paragraphs. "g, h" Part 2, Article 105 of the Criminal Code of the Russian Federation (murder by an organized group on hire), Part 3 of Art. 30 pp. "a, g, h" Part 2, Article 105 of the Criminal Code of the Russian Federation (attempted murder by an organized group on hire).
The body of Mr. Shabtai Von Kalmanovich with multiple gunshot wounds was found on the afternoon of November 2, 2009 in Moscow on the roadway of Novodevichy proezd in a Mercedes Benz 500. In addition, the driver of the car, born in 1976, was hospitalized from the scene; he also received gunshot wounds to the right side of the body. The man survived due to timely medical assistance.
The investigation and the court established that Mr. Tumgoev told his accomplices the alleged route of the victim's movement. After that, the defendants cruised around the city in a silver Lada Priora car without state license plates, driven by Mr. Belkhoroev. Mr. Kostoev opened fire at the car, having caught up with the "Mercedes Benz 500" in Smolenskaya embankment. Subsequently, investigators seized 19 9 mm shell casings from the scene.
The court sentenced Mr. Kostoev to 22 years in prison, Mr. Belkhoroev to 20 years in prison, and Mr.Tumgoev to 18 years in prison. The defendants will serve their sentence in a strict regime penal colony.
