Criminal investigation of fraud case regarding a land plot located on the territory of the Prielbrusye National Park has been completed

The Main Investigation Department of the Investigative Committee of the Russian Federation for the North Caucasus Federal District has completed the investigation of the criminal case against Leyla Dzhappueva. She is accused of committing a crime under Part 3 of Article 159 of the Criminal Code of the RF (fraud, that is, acquiring the right to someone else’s property by deception, committed on a large scale).

During the preliminary investigation, it has been established that from March 2016 to August 16, 2017, Dzhappueva filed a claim with the Elbrus District Court of the Kabardino-Balkarian Republic, presenting a previously recognized as illegal title document and concealing this legally significant fact from the court. Having received a court decision to satisfy her claims, she registered ownership of a land plot located on the territory of the “Specially Protected Natural Territory of the Prielbrusye National Park.”

As a result of Dzhappueva's criminal actions, the Russian Federation lost the right to the land plot, causing significant damage to the state, represented by the Territorial Administration of the Federal Agency for State Property Management in the Kabardino-Balkarian Republic.

By the measures taken during the preliminary investigation, the appellate instance of the Supreme Court of the Kabardino-Balkarian Republic annulled the previously issued decision of the Elbrus District Court of the Kabardino-Balkarian Republic as unlawful, and rejected Dzhappueva's claims.

The investigation has collected a sufficient evidence base, and therefore the criminal case against Dzhappueva has been sent to court for trial.
