In Tyumen Region magistrate to stand trial for unjust sentences and forgery

The investigating bodies of the Russia’s Investigative Committee for the Tyumen Region have completed investigating a criminal case against a magistrate from Tobolsk. He is charged with crimes under part 1 of article 305 of the RF Penal Code (passing knowingly unjust sentence – 2 counts) and part 2 of article 292 (forgery by an official – 2 counts).

According to investigators, in March 2011, the magistrate without trials on two criminal cases against residents of the Perm Territory and the Republic of Bashkortostan charged with a crime under article 319 of the RF Penal Code (offence of a representative of the authority), without public prosecutors or defenders passed two sentences finding both men guilty and punishing each of them with a fine.

In June 2011, following the applications filed by the Tobolsk prosecutor’s office the Tobolsk City Court cancelled the sentences as having been passed with gross violations of the legal procedures.

Considering the evidence gathered by the investigators, the accused pleaded guilty.

The criminal case with the approved indictment has been sent to court to be tried on the merits.
