In Kabardino-Balkaria probe opened against former judge of Nalchik City Court

The Chairman of the Russia’s Investigative Committee has opened a criminal investigation against former judge of Nalchik City Court of Kabardino-Balkaria Yelizaveta Botasheva. She is suspected of a crime under part 2 of article 305 of the RF Penal Code (pronouncing of a knowingly unjust judgment by a judge – 46 counts). The criminal case is filed in a single proceeding with the one also opened against Botasheva under part 2 of article 305 which is already under investigation.

According to investigators, in 2011, Botasheva, while serving as a judge in Nalchik City Court, acted in personal interests and announced 47 judgments on civil cases satisfying plaintiff’s claims made by a number of responders to Chernobyl accident to exact moral damages from the Ministry of Finance of the Russian Federation at the expense of the treasury. The said damages could not be paid under the current Russian laws.

Based on Botasheva’s unjust decisions over 250 million rubles was paid to the plaintiffs from the Russian treasury which involved grave consequences for the state.

The investigation is ongoing.
