Former head of Zheleznodorozhny sentenced in Moscow Region

The evidence collected by the Main Investigative Department of the Investigative Committee of Russia was found by court to be sufficient to sentence former head of Zheleznodorozhny of Moscow Region Evgeny Zhirkov and shareholder of Mosstroimechanizatsia-5 JSC Obid Yasinov. Depending on the role of each, they were found guilty of committing offenses under Part 6 of Article 290 (bribery) and Part 5 of Article 291 of the Criminal Code of Russia (bribe-giving).

The investigation and the court found that in 2014-2015 Zhirkov received non-residential premises of more than 1 thousand square meters and two apartments in the city of Zheleznodorozhny in the total value of more than 80 million rubles as an illegal remuneration from Yasinov. The real estate was intended as gratitude for the decisions previously taken by Zhirkov as head of the municipality in favor of the developer - JSC Mosstroimekhanizatsiya-5, which implemented the project to build a residential neighborhood.

The illegal transfer of property in order to conceal it was disguised by numerous financial and economic transactions and deals between organizations controlled by the defendants. The intermediary was Zhirkov's associate, Sergei Khvostov, who was the general director of Brit LLC, to which the rights to the properties were subsequently registered.

Sergey Khvostov was charged by investigators of the Investigative Committee of Russia with committing an offense under Part 4 of Article 291.1 of the Criminal Code (mediation in bribery), but he died before the start of the criminal proceedings. Given the position of his close relatives, who insisted on continuation of criminal proceedings against the deceased, which is consistent with the norms of criminal procedural law, the investigation was continued, after which all materials were transferred for their consideration on the merits in court. According to the results of the evaluation of the evidence presented by the Investigative Committee of Russia, Khvostov was also found guilty and the criminal prosecution was terminated in connection with his death.

The court sentenced Zhirkov to 9 years of imprisonment in a strict regime penal colony, Yasinov - to 7 years of imprisonment in a strict regime penal colony.
