Criminal case on incitement to hatred on grounds of nationality launched against musicians of «Bloodhound Gang» band

According to the results of preliminary inquiries, the Main Investigation Directorate of the Investigative Committee of Russia opened a criminal case against musicians of the American group «Bloodhound Gang» Franks James Moyer, Hennegan Jared Victor and other unidentified persons on the grounds of an offense under Subsection "c" of Part 2 of Article 282 of the RF Criminal Code (incitement to hatred or hostility, and humiliation of human dignity committed by an organized group).

In July 2013, a musical group «Bloodhound Gang» (USA) was invited to Ukraine by the National Concert Academy «NCA» for the implementation of live performances. Then, according to investigators , musicians D. Franks, J. Hennegan and other unidentified persons entered a criminal plot to commit actions aimed at humiliating the human dignity of Russian citizens on the grounds of nationality. To do this, the musicians found the State Flag of the Russian Federation. In this case, Franks and Hennegan understood that the performance of the musical group will be public and will be filmed, and thus their illegal actions will get publicized and draw the public interest.

July 30, 2013, during the performance at the nightclub "Green Theater" in Kiev, D.Franks began shouting abusive phrases in English to the address of the Russian Federation. J. Hennegan and other "Bloodhound Gang” members were on the stage with him and were supporting his illegal actions.

The next day, July 31, during the performance at the club "Ibitsa" in Odessa, the musician of «Bloodhound Gang» Hennegan, being on stage together with Franks and other band members, continued to implement their joint criminal intent and made ​​lewd acts with the Russian national flag, injurious to national dignity of citizens the Russian Federation.

According to the findings of the comprehensive psycho- linguistic forensic examination, Hennegan’s actions committed with the use of the national flag of Russia, are derogatory in nature and can be perceived as a desecration of a national symbol, touch and humiliate the national feelings of the Russians. In addition, the statement of Franks has been considered abusive, having an indecent form and derogatory towards members of a single nation, uniting all people living in the territory of Russia.

In accordance with Article 12 of the Criminal Code of the Russian Federation, foreign citizens who do not reside permanently in the Russian Federation who have committed crimes outside of the Russian Federation shall be subject to criminal liability under the Criminal Code of the Russian Federation in cases where the crime is directed against the interests of the Russian Federation, or a citizen of the Russian Federation , as well as in the cases provided by an international treaty of the Russian Federation, if foreign citizens who do not reside permanently in the Russian Federation have not been convicted in a foreign country and are subject to criminal liability in the territory of the Russian Federation. In this regard, at the present time, investigators are deciding on the organization of search for suspects Franks and Hennegan.
