The investigation and the court have established that one businessmen in 2012 decided to acquire land parcels in Khabarovsk for the subsequent construction of cottages. For this purpose he addressed to the public bodies where he received a reply that free areas that interest him were unavailable. Then he addressed to the minister of property relations of the Khabarovsk Territory Davidenko in person and complained about difficulties with land acquisition. The latter informed him about programme of free allocation of land parcels into possession of large families existed in the region. The businessman did not have rights to participate in this programme officially, but they have invented a plan for the businessman to get these land for trifling sum . The businessman asked an acquainted woman estate agent to help him. The estate agent found large families living in the Khabarovsk Territory. She was telling the people they had the right to get land for free, but immediately specified they were required to register many securities, spend time, money and bear relations in public bodies for it. She was making the proposals to which the large families agreed desirably. People wrote a notarial proxy on land transactions in the name of the estate agent and received 5-30 thousand rubles in exchange. Since April to September 2012 the businessman has collected the package of documents for 30 land parcels registered in a name of large families. Under the agreement previously reached the businessman transferred the documents to the Ministry of Property for allocation of land to large families. The minister signed the guidelines in accordance with which the large families became owners of land. In sober fact the businessman received all the signed papers and having proxies from large families he registered land in his name and in names of his relatives. Thus the businessman got nearly 3 hectares of land located in the city line, its value is over 40 million rubles.
Employees of the Khabarovsk Territory Department of the Russian Interior played an active role in crime investigation.
Punishment in form of 7,5 years of imprisonment in a general regime colony, as well as a fine in the amount of 1 million rubles has been set by the sentence of the court to Davidenko. Punishment in form of 5,5 years of imprisonment in a general regime colony has been set to Pozdeev.
It should be noted that in April 2014 the criminal case against a businessman has already been considered by the court of Khabarovsk and punishment in form of 3,5 years of suspended imprisonment had been appointed to him, as well as the fine in the amount of 500 thousand rubles. The same year the estate agent has been put on probation by 3,5 years of imprisonment and the fine of 200 thousand rubles. One more participant, the head of the department of the Ministry of Property Relations, was sentenced to 1 year imprisonment in a general regime colony.
