Charges pressed in probe in road accident in Khanty-Mansi Autonomous Area

The fourth department (based in the city of Yekaterinburg) of the Investigative Committee’s Head Office continues an investigation in crimes under part 5 of Article 264 and part 3 of Article 238 of the RF Penal Code (violation of the road code entailing death of two or more people; provision of services that do not meet safety standards).

There are 4 persons of interest in this case at the moment.

Driver of the bus carrying children Marat Zainullin has been charged with violation of the road code entailing death of two or more people under Part 5 of Article 264 of the RF Penal Code. According to investigators Zainullin drove the vehicle without considering the width of the road, the size of vehicles, necessary distances between them and was driving too fast without any account of the state of the road and weather conditions. He lost control of the vehicle and collided with a Volvo heavy hauler driven by Rail Saitkhanov and carrying an oversize cargo.

As a result of Zainulli’s actions and the subsequent accident 12 people were killed, including 11 children.

Rail Saitkhanov, the driver of the hauler has also been charged with the same crime under Part 5 of Article 164 of the RF Penal Code. The investigators believe that he also misjudged the width of the road, sizes of vehicles, necessary distances between them and was driving too fast without any account of the state of the road and weather conditions. He lost control of the vehicle and collided with the bus carrying children.

Representative of the sole proprietor that owned the bus Alexander Sidoruk has been charged with provision of unsafe services that entailed death of two or more people under Part 3 of Article 238 of the RF Penal Code. He accused of having provided the unsafe bus for transporting children.

The investigators have asked courts to remand all three of them in custody pending trial.

Criminal proceedings have also been initiated against director of Sibiryak Children and Youth Sports School Irina Tarasova suspected of negligence under Part 3 of Article 293 of the RF Penal Code. Tarasova had not concluded a proper contract for transportation and had not sent the traffic police a notice that there was going to be an organized trip of children. At the same time, she had not organized the transportation or assigned a person responsible for its organization. This led to the fact that the athletes left Khanty-Mansiysk in the unsafe bus.
