Suspects of negligence and unsafe services entailing death of child in fountain held in Volgograd

The Volgograd Region investigating bodies of the Russia’s Investigative Committee following a procedure check have opened a criminal investigation in crimes under part 2 of article 293 of the RF Penal Code (negligence entailing death of a person), paragraph “c” of part 2 of article 238 (provision of unsafe services that entailed death of a person) after the death of a 12-year-old boy in the Globe Fountain, located in the park of 70 years of Victory.

On 20 September 2015, about 3 PM, a dead body of the 12-year-old boy was found on the bottom of the fountain. According to preliminary information, the boy was bathing in the fountain when he got sucked to the holes of the drain pipes which were working at the moment.

At present the investigators know that the building of the fountain had been organized by the housing and communal service company of Krasnooktyabrsky district, whose director is Olga Lemyakina. She decided that there had to be a fountain built in the park by the City Day, she agreed it with the officials of the district administration and hired a contractor ASTI Alfa company. Because of there was so little time to accomplish everything, the conclusion of a municipal contract was basically ignored – the fountain was built by a commercial company allegedly free of charge, but verbally it was guaranteed to win the next contract. The day before the celebration, on 12 September 2015, the fountain was put into operation and a week later the child drowned in it. It is remarkable that formally the tender was held on 14 September 2015, and the official documents on the start of the building were to be signed only today.

At present, Lemyakina and the CEO of the contractor company Alexander Poshnagov are detained. Restraint is expected.

The investigators are going to identify all the individuals involved in the death of a boy and classify actions of all officials responsible for permission to build and put in operation the dangerous structure. The investigation is ongoing.
