The court has considered evidence collected by the Amur Region investigative bodies of the Russia's Investigative Committee sufficient to convict former mayor of Blagoveshchensk Alexander Migulya. He was considered guilty of crimes under part 2 of article 286 of the RF Penal Code (abuse of power), paragraph "b" of part 2 of article 285.1 of the RF Penal Code (misapplication of budget funds committed), part 2 of article 285 of the RF Penal Code (abuse of power).
According to investigation and court, being a head of municipality - a mayor of Blagoveshchensk - in December 2008 he exceeded his power by allocating a land plot in Mukhinka settlement to a limited liability company, headed by his associate in violation of procedure established by land legislation. The land plot was allocated, but decision on land allocation opportunity was not published, evaluation not carried out, market price not determined, and real designated use not specified, although these procedures are obligatory in such cases. So, the land plot was sold to the said organization for slightly more than 2.5 million rubles, although as concluded the estimating forensic examination, the price of the land plot in December 2008 was about 28 million rubles. So, the Russian Federation budgetary system has not received over 25 million rubles of profit.
According to investigators, budgets of Amur Region and Blagoveshchensk are deficit, so the fact that they have not received said amount of money in 2008 violated interests of society and state.
Also, in 2006 Migulya, aiming to provide material benefit for a limited liability company unlawfully spent budget funds and issued a resolution to buy a highway bridge over the Chigiri river in the town of Blagoveshchensk for an overstated price without tendering procedures or contracting. Basing on his resolution, a contract was signed between municipalty property administration committee and owner of the bridge.
Moreover, in the period from 2007 to 2010 Migulya, aiming to guarantee material profit for the commercial organization controlled by him through development of Severny rural district of Blagoveshchensk, provided for prolongation of due date of full payments under agreement of purchase and sale of leasehold for land to be used for residential development. Also the company was freed from rent for using the land plot. As a result of Migulya's illegal actions, the RF budget system did not receive over 26 million rubles of profit.
The criminal case was launched in April 2011. He was requested to meet with the investigator for investigative procedures through several summons numerously sent to known addresses of Migulya's probable residence. But the suspect never came. Investigative and operative procedures failed to locate him, and in June 2011 Alexander Migulya was put into an international wanted list. On May 12, 2015 as a result of investigative and operative actions he was arrested in Lipetsk Region, then transferred to Amur Region and was placed in a pretrial detention facility. The criminal case had over 30 volumes, letter of accusation counted 166 pages. During the criminal case investigation, several handwriting, appraisals and other examinations have been carried out. The criminal case had been investigated in conditions of increased public interest.
The court sentenced Migulya to 9 years to be served in colony.
