The Head Office of the Investigative Committee has completed criminal proceedings against Oleg Mikheyev, who was a member of the State Duma of the 6^th convocation. He is charged with a crime under Part 3 of Article 30, Part 4 of Article 159 of the RF Penal Code (attempted fraud).

According to investigators, in September 2007, as chairman of the board of directors and the owner of the shares of OAO Volgoprombank, Mikheyev decided to get hold of the bank’s funds in the course of a transaction to sell its stake in the bank. To do that, Mikheyev signed fictitious paid services contracts with legal entities under his control, and under those agreements he undertook to repay loans of those entities owed to Volgoprombank in the amount of more than 1.45 billion rubles. Also, the defendant issued guarantee contracts under which Volgoprombank acted as a guarantor for the obligations of legal entities under paid services contracts. However, Mikheyev instructed the bank's president not to record the bank's liabilities and thus concealed information about the presence of liabilities of the Volgoprombank to him from the buyer of shares. Paid services contracts between Mikheyev and controlled entities were not fulfilled.

Volgoprombank merged with OAO Promsvyazbank in 2010, and in 2011, having the above-mentioned documents, Mikheyev sent to Sovetsky District Court of Volgograd the statement of claim for the recovery of 2.1 billion rubles from Promsvyazbank as the assignee of Volgoprombank. However, the court dismissed the claims.

Mikheyev denied the charges, but the investigators’ version was confirmed by interviews of injured parties, witnesses, conclusions of experts, protocols of searches and seizures, and results of other investigative operations.

The investigators have enough evidence so the criminal case with the signed indictment has been referred to court.

The investigation against Mikheyev over fraudulent obtaining of ownership of the assets of OAO Volgograd Engine Plane is ongoing.
