Head of division in guardianship department of Moscow Region Education Ministry charged with negligence entailing death of adopted girl

The Moscow Region Directorate of the Investigative Committee has charged head of orphaned children settlement division of the Kashira and Ozyory guardianship department under the Moscow Region Education Ministry with negligence that entailed death of person by negligence under part 2 of Article 293 of the RF Penal Code.

As investigators revealed, in 2010, the Chernikov husband and wife adopted a 4-month-old girl. The head of the said divisions was to look into living, keeping and raising conditions in the family as it was her duty to run yearly checks in adopting families and to write reports on them. The investigators found out that the administration of a day care center the girl had attended, representatives of the parent’s committee and the grandmother had lodged complaints with the said divisions about systematic physical violence used against the child by the father. However, nothing was done. The woman made formal yearly reports on the conditions in the family without visiting the household in Ozyory. Instead of detailed analysis of the child’s living conditions, the report said that all requirements of the family were met, they needed no additional assistance, the adoption was a success and the conditions in the family were fine.

This way, improper discharge of duties by the head of the division not only entailed multiple violations of the child’s legal rights, but basically created all conditions for the major crime to have been committed against the child. For a long time, between November 2013 and 1 April 2016, the child was systematically psychologically and physically abused, the adopted parents scornfully, brutally and roughly, humiliated the girl, beat her and hit with hands and a belt, kicked her in different parts of her body and the head: pulled her hair; forbade her getting up from her bad for a long time so that the child had to relieve herself while being dressed; demanded her to pick up nettle with bare hands and put it in her underwear; tied her by the hands to the stairs of a bunk bed for a long time; made her eat food from the floor without using her hands; deprived her of food which ended up in the girl’s death on 1 April 2016.

In addition, the Moscow Region Directorate of the Investigative Committee charged the parents with torturing the child under Part 2, items “d”, “f” of Article 117, failure to discharge the duty of bringing up a minor under Article 156 and murder under Part 2, item “c” of Article 105 of the RF Penal Code. The Chernikovs are now in custody pending trial.
