Deputy Minister for territorial development, architecture and town building in Rostov Region charged with exceeding official powers

The investigating bodies of Southern Federal District of the Russia’s Investigative Committee have brought charged against deputy minister for territorial development, architecture and town building of Rostov Region – chief architect of Rostov Region Alexey Polyansky. He is charged with a crime under part 1 of article 286 of the RF Penal Code (exceeding official powers).

According to investigators, in the period between 1 April 2004 and 19 January 2011 Polyansky was chief architect of the city – director of municipal institution Department of architecture and town building of Rostov-on-Don. He regulated the town building, reconciled state, public and private interests in the area of town building; organized preparing the project on amending land use and building rules, prepared documents to issue permit to conditionally allowed kind of using the land or object of capital building, organized preparing and holding public hearings on building. Polyansky also provided preparing orders determining kind of using lands. According to investigators the suspect, ignoring the fact that the lands were in the zone of natural landscapes, on 23 December 2010, in Department of architecture and town building of Rostov-on-Don illegally issued an order establishing kind of allowed use “for gardening” for 22 land pieces with a total area of 1.65 ha with cadaster cost of 16 million 910 thousand 520 rubles and owned by the municipality.

Polyansky’s actions connected with illegal change of town building regulations of the landscape areas in 22 pieces of land with a total area of 1.65 ha entailed the fact that those lands were illegally put on cadaster register, were subject to advantageous privatization and seized from the municipal property, of market cost 30 million 560 thousand rubles. Polyansky’s deliberate actions entailed considerable violation of the state interests protected by law, namely – stripped the city of Rostov-on-Don of the right to dispose in due manner of the abovementioned lands, to build there blocks of flats, initially provided for by the general plan of town development. Investigation is ongoing.
